A BILL FOR AN ACT

 

 

RELATING TO STANDARDS OF CONDUCT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 12, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§12‑    Ethics filing prerequisite; state offices.  As a prerequisite to qualifying as a candidate for the primary election under this chapter, a candidate for state office shall file an initial financial disclosure statement as required under section 84-17, along with the filing of nomination papers under section 12-6.  A copy of the initial financial disclosure statement shall be filed with the state ethics commission in accordance with section 84-17."

     SECTION 2.  Section 84-17, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The disclosure of financial interest required by this section shall be filed:

     (1)  Between January 1 and May 31 of each year;

     (2)  Within thirty days of one's election or appointment to a state position enumerated in subsection (c); or

     (3)  Within thirty days of separation from a state position if a prior financial disclosure statement for the position was not filed within the one hundred eighty days preceding the date of separation;

provided that candidates for state elective offices [or the constitutional convention shall file the required statements no later than twenty days prior to the date of the primary election for state offices or the election of delegates to the constitutional convention.] shall file a copy of their initial financial disclosure statement that has been filed with their nomination papers under sections 12‑   and 12-6, by no later than the close of business on the first business day following the filing of nomination papers; provided that the required form of the financial disclosure statement shall be made available by the state ethics commission to candidates for state office prior to their filing of nomination papers; and provided further that candidates for election to the constitutional convention shall file their financial disclosure statements no later than twenty days prior to the date of the election to choose delegates."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
