A BILL FOR AN ACT

 

 

RELATING TO ARBITRATION.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 658A-21, Hawaii Revised Statutes, is amended as follows:

     1.  By amending the title to read:

     "[[]§658A-21[]]  Remedies; fees, costs, and expenses of arbitration proceeding."

     2.  By amending subsection (b) to read:

     "(b)  An arbitrator may award reasonable attorney's fees, costs, and other reasonable expenses of arbitration if such an award is authorized by law in a civil action involving [the same] a comparable claim or by the agreement of the parties to the arbitration proceeding."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050.

Allows an arbitrator to award costs in addition to attorney's fees and other reasonable expenses of arbitration if the award authorized by law in a civil action involves a comparable, rather than same, claim.  Effective 7/1/2050.  (SD1)
