A BILL FOR AN ACT
relating to family leave.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 398-3, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:
"(a) An employee shall be entitled to a
total of four weeks of family leave during any calendar year [upon the birth
of a child of the employee or the adoption of a child, or to care for the
employee's child, spouse or reciprocal beneficiary, or parent with a serious
health condition.]:
(1) Upon the birth or adoption of a child of the employee;
(2) To care for the employee's child, spouse, reciprocal beneficiary, or parent, with a serious health condition; or
(3) Upon the occurrence of any qualifying exigency (as defined by Title 29 Code of Federal Regulations Section 825.126) arising out of the fact that the spouse, reciprocal beneficiary, child, or parent of the employee is on active duty, or has been notified of an impending call or order to active duty, in the armed forces of the United States in support of a contingency operation."
SECTION 2. The director of labor and industrial relations shall adopt rules in consultation with the department of defense in accordance with chapter 91, Hawaii Revised Statutes, to implement section 398‑3(a)(3), Hawaii Revised Statutes.
SECTION 3. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 4. This Act shall take effect on December 21, 2012.
