A BILL FOR AN ACT

 

 

RELATING TO MOTOR VEHICLES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part XII to be appropriately designated and to read as follows:

     "§291C-     Smoking in motor vehicles.  (a)  No person shall smoke in a motor vehicle in which a person under the age of eighteen is present.

     (b)  For the purposes of this section, "smoke" means to inhale or exhale the fumes of tobacco or any other plant material, or to burn or carry any lighted smoking equipment for tobacco or any other plant material."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
