SENATE CONCURRENT
RESOLUTION
requesting the Hawaii Community Development Authority and the City and County of Honolulu to conduct separate examinations of and to report on preparatory steps necessary to transfer jurisdiction of the Kakaako district to the City and County of Honolulu.
WHEREAS, the Hawaii Community Development Authority was established in 1976 to provide a mechanism to address areas of the State that are substantially undeveloped, blighted, or economically depressed, and potentially in need of renewal, renovation, or improvement to alleviate dilapidation, deterioration, and age that make those areas an economic or social liability; and
WHEREAS, the Hawaii Community Development Authority determines community development programs and cooperates with private enterprise and the various components of federal, state, and county governments in bringing plans to fruition; and
WHEREAS, in 1976, the Legislature found that the Kakaako district is in close proximity to the central business district, the government center, commercial, industrial, and market facilities, major existing and contemplated transportation routes, and recreational and service areas; and
WHEREAS, furthermore, the Legislature noted that the Kakaako community development district, due to its function at that time as a service and light industrial area, was relatively underdeveloped and had the potential for increased growth and development that can alleviate community needs such as low-income housing, parks and open space, and commercial and industrial facilities; and
WHEREAS, accordingly, the Hawaii Community Development Authority was tasked to plan a mixed-use district in coordinating community development in the Kakaako district whereby industrial, commercial, residential, and public uses may coexist compatibly within the same area; and
WHEREAS, in 2005, the Legislature established a state cultural public market within the Kakaako district located on land within the Kakaako Makai area, defined as the area within the Kakaako community development district that is from the east side of Kewalo basin at the ewa wall of Ala Moana Park, to Forrest Avenue, and from Ala Moana Boulevard to the ocean, and provided the framework upon which plans for the development of the Kakaako Makai area are to be developed and implemented; and
WHEREAS, in the intervening years since the Kakaako community development district was established, the area has been greatly improved and developed; and
WHEREAS, furthermore, to facilitate the construction of the City and County of Honolulu's Rail Transit project, which runs through the Kakaako district on the way to the downtown area and Ala Moana, it is appropriate to transfer jurisdiction over the Kakaako district to the City and County of Honolulu; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-fifth Legislature of the State of Hawaii, Regular Session of 2010, the House of Representatives concurring, that the Hawaii Community Development Authority and the City and County of Honolulu are requested to conduct separate examinations of and to report to the Legislature on preparatory steps necessary to transfer jurisdiction of the Kakaako district to the City and County of Honolulu; and
BE IT FURTHER RESOLVED that the Hawaii Community Development Authority is requested to include in its separate report any potential barriers, concerns, requirements, and other necessary conditions to relinquishing jurisdiction of the Kakaako district to the City and County of Honolulu, based on the assumption that any agreements entered into or permits issued by the Hawaii Community Development Authority prior to any transfer of jurisdiction will not be affected by the transfer; and
BE IT FURTHER RESOLVED that the City and County of Honolulu is requested to include in its separate report any potential barriers, concerns, requirements, and necessary conditions it anticipates will need to be addressed to accept the transfer of jurisdiction of the Kakaako district from the State, based on the assumption that any agreements entered into or permits issued by the Hawaii Community Development Authority prior to any transfer of jurisdiction will not be affected by the transfer; and
BE IT FURTHER RESOLVED that the Hawaii Community Development Authority and the City and County of Honolulu are requested to submit their respective reports to the Legislature, including any necessary proposed legislation, no later than twenty days prior to the convening of the Regular Session of 2011; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Governor, the Executive Director of the Hawaii Community Development Authority, and the Mayor of the City and County of Honolulu.
