SENATE CONCURRENT
RESOLUTION
requesting the STATE HISTORIC PRESERVATION DIVISION OF THE department of land and natural resources to formulate and provide a five-year plan for existing and upcoming projects.
WHEREAS, the Legislature finds that section 6E-42, Hawaii Revised Statutes (Section 6E-42), plays an essential role in the protection and management of the State's historical places, burial sites, and aviation artifacts; and
WHEREAS, Section 6E-42 requires agencies and officers of the State and its subdivisions prior to project approval, to submit for review by the Department of Land and Natural Resources' State Historic Preservation Division all projects that may affect historic properties; and
WHEREAS, due to the current demands for new housing construction, increases in development of commercial properties, and the need for added infrastructure to support the construction and developments, there is an unacceptably large backlog of proposed projects that require review and comment required by the state historic preservation law before the State or any of the counties can approve the project, issue permits, license certificates, land use change, subdivision or other requirements for use; now, therefore,
BE IT RESOLVED by the Senate of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2021, the House of Representatives concurring, that the Department of Land and Natural Resources is requested to formulate and provide a five-year plan to ensure that the review of existing and upcoming projects within the State Historic Preservation Division occurs within a four-month timeframe; and
BE IT FURTHER RESOLVED that the State Historic Preservation Division is urged to review proposed projects as statutorily required in an expeditious manner, while ensuring that significant historic properties receive consideration consistent with existing practices; and
BE IT FURTHER RESOLVED that the Department of Land and Natural Resources is requested to submit a report to the Legislature on the status and progress of its five-year plan of project reviews and an organizational chart of the State Historic Preservation Division no later than twenty days prior to the convening of the Regular Session of 2022; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources and Director of the State Historic Preservation Division.
