SENATE RESOLUTION
URGING THE COUNTIES of the state of hawaii TO IMPLEMENT procedures or technologies to ease the process in which driver's licenses are renewed.
WHEREAS, in 2005, Congress passed the federal REAL ID Act of 2005, P.L. 109-13, which implemented the 9/11 Commission's recommendation that the federal government "set standards for the issuance of source of identification, such as driver's licenses"; and
WHEREAS, to be in compliance with the federal REAL ID Act of 2005, a state must require "the presentation and verification of the following information before issuing a driver's license" to a person:
(1) A photo identity document, except that a non-photo identity document is acceptable if it includes both the person's full legal name and date of birth;
(2) Documentation showing the person's date of birth;
(3) Proof of the person's social security account number or verification that the person is not eligible for a social security account number; and
(4) Documentation showing the person's name and address of principal residence; and
WHEREAS, compliance with the REAL ID Act of 2005 ensures that holders of Hawaii's driver's licenses or state identification cards will have access to federal facilities and be able to board a commercial aircraft; and
WHEREAS, the State was deemed to be fully compliant with the requirements of the REAL ID Act of 2005 by the federal Department of Homeland Security in September 2013; and
WHEREAS, since the State implemented the requirements in 2012, there has been growing frustration over the time and process in which driver's licenses are renewed because:
(1) People do not fully understand that federal law requires a state to collect these documents when the state did not previously require such documents for the issuance or renewal of a driver's license;
(2) Incidents have occurred where documents already submitted have been lost requiring persons to present the documents again upon the next renewal; and
(3) The number of expiring driver's licenses has increased dramatically over the last year due to a change in the law in 2010 that changed the driver's license's period of validity from six years to eight years; and
WHEREAS, this frustration is exacerbated by new federal guidance that requires REAL ID compliant identification to be marked with a gold star, beginning October 2020, to gain access to federal facilities and to board a commercial aircraft; and
WHEREAS, counties have implemented some procedures and technologies to streamline and ease the process for renewing a driver's license, such as the City and County of Honolulu's online appointment portal, AlohaQ; and
WHEREAS, despite these current procedures and technologies, there continues to be a level of frustration that must be addressed for a better customer experience; now, therefore,
BE IT RESOLVED by the Senate of the Thirtieth Legislature of the State of Hawaii, Regular Session of 2019, that the counties of the State of Hawaii are urged to implement further procedures or technologies to ease the process in which driver's licenses are renewed while remaining in compliance with federal and state law; and
BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Director of Transportation and mayors of each county.
