  1 An Act relating to school corporation funds by authorizing
  2    certain transfers to the student activity fund and including
  3    effective date provisions.

  1  1    Section 1.  Section 298A.8, Code 2017, is amended to read as
  1  2 follows:
  1  3    298A.8  Student activity fund.
  1  4    1.  The student activity fund is a special revenue fund.
  1  5 A student activity fund must be established in any school
  1  6 corporation receiving money from student=related activities
  1  7 such as admissions, activity fees, student dues, student
  1  8 fund=raising events, or other student=related cocurricular or
  1  9 extracurricular activities. Moneys in this fund shall be used
  1 10 to support only the cocurricular program defined in department
  1 11 of education administrative rules.
  1 12    2.  For school budget years beginning on or after July 1,
  1 13 2017, the board of directors of a school corporation may,
  1 14 by board resolution, transfer from the school corporation's
  1 15 general fund to the student activity fund an amount necessary
  1 16 to purchase protective and safety equipment required for any
  1 17 extracurricular interscholastic athletic contest or competition
  1 18 that is sponsored or administered by an organization as defined
  1 19 in section 280.13.
  1 20    Sec. 2.  EFFECTIVE UPON ENACTMENT.  This Act, being deemed of
  1 21 immediate importance, takes effect upon enactment.
  1 22                           EXPLANATION
  1 23 The inclusion of this explanation does not constitute agreement with
  1 24 the explanation's substance by the members of the general assembly.
  1 25    Current Code section 298A.8 requires a student activity
  1 26 fund to be established in any school corporation receiving
  1 27 moneys from student=related activities such as admissions,
  1 28 activity fees, student dues, student fund=raising events,
  1 29 or other student=related cocurricular or extracurricular
  1 30 activities. Moneys in the student activity fund must be used
  1 31 to support only the cocurricular program defined in department
  1 32 of education administrative rules.
  1 33    Under this bill, for school budget years beginning on
  1 34 or after July 1, 2017, the board of directors of a school
  1 35 corporation may, by board resolution, transfer from the school
  2  1 corporation's general fund to the student activity fund an
  2  2 amount necessary to purchase protective and safety equipment
  2  3 required for any extracurricular interscholastic athletic
  2  4 contest or competition that is sponsored or administered by an
  2  5 organization as defined in Code section 280.13.
  2  6    The bill takes effect upon enactment.
