1.
NEW
SECTION
.

Drinking
water
requirement.
1
1.
Except
as
provided
in
subsection
2,
a
school
district
2
shall
provide
access
to
free,
fresh
drinking
water
during
meal
3
times
in
the
food
service
areas
of
the
attendance
centers
4
under
its
jurisdiction,
including
but
not
limited
to
areas
5
where
reimbursable
meals
under
the
federal
Richard
B.
Russell
6
National
School
Lunch
Act,
42
U.S.C.
§
1751
et
seq.,
or
the
7
school
breakfast
program
established
by
section
4
of
the
8
federal
Child
Nutrition
Act
of
1966,
42
U.S.C.
§
1773,
are
9
served
or
consumed.
A
school
district
may
comply
with
this
10
section
by,
among
other
means,
providing
cups
and
containers
11
of
water
or
providing
bottled
water
donated
to
the
school
12
district.

2.
The
majority
of
the
members
of
the
board
of
directors
14
of
a
school
district
may
adopt
a
resolution
stating
that
the
15
school
district
is
unable
to
comply
with
the
requirements
of
16
subsection
1
and
demonstrating
the
reasons
why
the
school
17
district
is
unable
to
comply
due
to
fiscal
constraints
or
18
health
and
safety
concerns.
The
proposed
resolution
shall
be
19
posted
on
an
internet
site
maintained
by
the
school
district
20
and
shall
include
the
date,
time,
and
place
of
the
board
21
meeting
at
which
the
board
shall
take
action
to
adopt
the
22
resolution.
The
board
shall
take
action
on
the
resolution
23
within
thirty
days
of
the
internet
posting
or
at
the
next
24
regularly
scheduled
board
meeting,
whichever
occurs
later.

EXPLANATION
26
This
bill
requires
a
school
district
to
provide
access
to
27
free,
fresh
drinking
water
during
meal
times
in
school
food
28
service
areas
unless
the
school
board
by
a
majority
of
its
29
members
adopts
a
resolution
stating
that
it
is
unable
to
comply
30
with
this
requirement
and
demonstrating
the
reasons
why
it
31
is
unable
to
comply
due
to
fiscal
constraints
or
health
and
32
safety
concerns.
The
proposed
resolution
must
be
posted
on
a
33
school
district
internet
site
and
the
board
must
take
action
34
on
the
resolution
within
30
days
of
the
posting
or
at
the
next
