Section
1.
Section
8A.413,
subsection
13,
Code
2014,
is

amended
to
read
as
follows:

13.
For
transfer
from
a
position
in
one
state
agency
3
to
a
similar
position
in
the
same
state
agency
or
another
4
state
agency
involving
similar
qualifications,
duties,
5
responsibilities,
and
salary
ranges.
Whenever
an
employee
6
transfers
or
is
transferred
from
one
state
agency
to
another
7
state
agency,
the
employee’s
seniority
rights,
any
accumulated
8
sick
leave,
and
accumulated
vacation
time,
as
provided
in
9
the
law,
shall
be
transferred
to
the
new
place
of
employment
10
and
credited
to
the
employee.
Employees
who
are
subject
to
11
contracts
negotiated
under
chapter
20
which
include
transfer
12
provisions
shall
be
governed
by
the
contract
provisions.
In
13
addition,
the
rules
shall
provide
that
an
employee
who
resigns
14
from
a
position
in
one
state
agency
and
commences
employment
in
15
a
similar
position
with
another
state
agency
involving
similar
16
qualifications,
duties,
responsibilities,
and
salary
ranges
17
within
fifteen
days
of
the
employee’s
resignation
shall
be
18
deemed
to
be
a
transfer
from
one
state
agency
to
another
state
19
agency
for
purposes
of
the
protections
of
this
subsection.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
22
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
department
of
administrative
services
24
to
adopt
rules
relative
to
state
human
resource
management
25
providing
that
an
employee
who
resigns
from
a
position
in
one
26
state
agency
and
commences
employment
in
a
similar
position
27
with
another
state
agency
within
15
days
shall
be
deemed
to
28
have
transferred
from
one
state
agency
to
another
state
agency
29
for
purposes
of
transferring
the
employee’s
seniority
rights,
30
any
accumulated
sick
leave,
and
accumulated
vacation
time,
to
31
the
new
place
of
employment.
