  1 An Act concerning the authority of certain beer manufacturers
  2    to sell beer at retail.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 123.130, subsection 3, Code 2016, is
  1  2 amended to read as follows:
  1  3    3.  All special class "A" and special class "AA" premises
  1  4 shall be located within the state. A person who holds a
  1  5 special class "A" or special class "AA" permit for the same
  1  6 location at which the person holds a class "C" liquor control
  1  7 license or class "B" beer permit may manufacture and sell beer
  1  8 to be consumed on the premises, may sell beer to a class "A"
  1  9 or class "AA" permittee for resale purposes, and may sell beer
  1 10 to distributors outside of the state that are authorized by
  1 11 the laws of that jurisdiction to sell beer at wholesale.  In
  1 12 addition, a person who holds a special class "A" or special
  1 13 class "AA" permit for the same location at which the person
  1 14 holds a class "C" liquor control license or class "B" beer
  1 15 permit may manufacture and sell beer at retail in sealed
  1 16 containers of not more than sixty=four ounces to be consumed
  1 17 off the premises.  Beer sold at retail as provided in this
  1 18 subsection shall be subject to the barrel tax as provided in
  1 19 section 123.136.
  1 20                           EXPLANATION
  1 21 The inclusion of this explanation does not constitute agreement with
  1 22 the explanation's substance by the members of the general assembly.
  1 23    This bill allows a person who holds a special class "A"
  1 24 or special class "AA" permit to manufacture beer and a class
  1 25 "C" liquor control license or class "B" beer permit for the
  1 26 same location to manufacture and sell beer at retail in sealed
  1 27 containers of not more than 64 ounces to be consumed off the
  1 28 premises.  The bill provides that beer sold at retail shall be
  1 29 subject to the barrel tax as provided in Code section 123.136.
