NEW SECTION. 274.3 Exercise of powers ==== 1 2 construction. 1 3 1. The board of directors of a school district shall 1 4 operate, control, and supervise all public schools located 1 5 within its district boundaries and may exercise any broad and 1 6 implied power, not inconsistent with the laws of the general 1 7 assembly, related to the operation, control, and supervision 1 8 of those public schools. 1 9 2. Notwithstanding subsection 1, the board of directors of 1 10 a school district shall not have power to levy any tax unless 1 11 expressly authorized by the general assembly. 1 12 3. This chapter, chapter 257 and chapters 275 through 301, 1 13 and other statutes relating to the boards of directors of 1 14 school districts and to school districts shall be liberally 1 15 construed to effectuate the purposes of subsection 1. 1 16 EXPLANATION 1 17 The inclusion of this explanation does not constitute agreement with 1 18 the explanation's substance by the members of the general assembly. 1 19 This bill relates to the exercise of powers by the board of 1 20 directors of a school district. 1 21 The bill authorizes a school board to exercise any broad or 1 22 implied power, not inconsistent with the laws of the general 1 23 assembly, related to the operation, control, and supervision 1 24 of the public schools located within its district boundaries. 1 25 However, the authority does not encompass the power to levy 1 26 any tax unless expressly authorized by the general assembly. 1 27 Statutes relating to school boards and school districts shall 1 28 be liberally construed to effectuate the authority granted 1 29 under the bill.
