H.F. 699 Section 1. NEW SECTION . 232.192 Juvenile justice 1 delinquency prevention. 2 1. Contingent on a specific appropriation for these 3 purposes, the judicial branch shall do all of the following: 4 a. Use research and data to develop, evaluate, and 5 administer gender-responsive, and developmentally and 6 culturally competent, evidence-based programs and services 7 to address the identified criminogenic needs of youth in the 8 community throughout all stages of involvement with juvenile 9 court services and the juvenile court including prevention, 10 treatment, and reentry. 11 b. Develop programs targeting services that reduce or 12 eliminate the need for out-of-home placement. 13 c. Develop services to promote continuity of care that are 14 provided collaboratively within the community and that are 15 delivered through planning and community groups, organizations, 16 and resources. 17 d. Develop community-based and evidence-driven programs and 18 services that specifically address the needs of juvenile court 19 services and court-involved youth transitioning into adulthood. 20 2. Programs and services required by this section 21 shall focus on community safety and be driven by validated 22 assessments to ensure programming is matched to youth risk 23 level and individual needs. 24 Sec. 2. 2022 Iowa Acts, chapter 1098, section 92, subsection 25 2, is amended by striking the subsection. 26 Sec. 3. REPEAL. 2022 Iowa Acts, chapter 1098, section 70, 27 is repealed. 28 Sec. 4. EFFECTIVE DATE. The following, being deemed of 29 immediate importance, take effect upon enactment: 30 1. The section of this Act repealing 2022 Iowa Acts, chapter 31 1098, section 70. 32 2. The section of this Act amending 2022 Iowa Acts, chapter 33 1098, section 92. 34 EXPLANATION 35 -1- LSB 1225HZ (1) 90 cm/ns 1/ 2
H.F. 699 The inclusion of this explanation does not constitute agreement with 1 the explanation’s substance by the members of the general assembly. 2 In 2022, the general assembly passed legislation repealing 3 Code section 232.191, relating to early intervention and 4 follow-up programs for juveniles by the department of health 5 and human services, and enacted Code section 232.192, relating 6 to early intervention and follow-up programs for juveniles 7 by juvenile court services of the judicial branch. The 8 legislation will take effect July 1, 2023. This bill replaces 9 the enactment of Code section 232.192. 10 The bill instead requires the judicial branch to, subject 11 to available moneys, develop programs and services related 12 to juvenile justice delinquency prevention, as set forth in 13 the bill. The programs and services shall focus on community 14 safety and match youth risk level and individual needs. 15 The bill repeals the provision requiring juvenile court 16 services to develop early intervention and follow-up programs 17 that was passed by the general assembly in 2022 and would have 18 taken effect July 1, 2023.
