  1  1    Section 1.  NEW SECTION.  481A.56A  Retrieval of wounded deer
  1  2 by leashed dogs.
  1  3    A person having a valid hunting license and a valid deer
  1  4 hunting license who has wounded a deer while hunting may use a
  1  5 dog to locate and retrieve the wounded deer. The hunter or any
  1  6 person in the company of the hunter shall not possess a firearm
  1  7 or bow while using a dog in this manner and shall have the
  1  8 dog leashed and under control at all times during the search.
  1  9 A person shall obtain permission from the owner or tenant of
  1 10 private property before using a dog to locate a wounded deer
  1 11 on the private property. The commission shall adopt rules
  1 12 pursuant to chapter 17A to implement this section.
  1 13    Sec. 2.  Section 805.8B, subsection 3, paragraph c, Code
  1 14 2018, is amended to read as follows:
  1 15    c.  For violations of sections 481A.6, 481A.21, 481A.22,
  1 16 481A.26, 481A.50, 481A.56, 481A.56A, 481A.60 through, 481A.61,
  1 17  481A.62, 481A.83, 481A.84, 481A.92, 481A.123, 481A.145,
  1 18 subsection 3, sections 483A.6A, 483A.7, 483A.8, 483A.23,
  1 19 483A.24, and 483A.28, the scheduled fine is twenty=five
  1 20 dollars.
  1 21                           EXPLANATION
  1 22 The inclusion of this explanation does not constitute agreement with
  1 23 the explanation's substance by the members of the general assembly.
  1 24    This bill creates new Code section 481A.56A to allow a
  1 25 hunter with a valid hunting license and deer hunting license
  1 26 who wounds a deer while hunting to use a dog to locate and
  1 27 retrieve the wounded deer. The hunter or any person in the
  1 28 company of the hunter shall not possess a firearm or bow while
  1 29 using a dog in this manner and shall have the dog leashed and
  1 30 under control at all times during the search. A person must
  1 31 obtain permission from the owner or tenant before using a dog
  1 32 to locate a wounded deer on private property. The natural
  1 33 resource commission shall adopt rules pursuant to Code chapter
  1 34 17A to implement this provision.
  1 35    A violation of the new provision is punishable by a scheduled
  2  1 fine of $25.
