Section
1.
Section
321.275,
Code
2021,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
9.
Helmets
required
for
minors.
3
a.
A
person
under
eighteen
years
of
age
shall
not
operate
4
a
motorcycle
or
motorized
bicycle
on
the
highways
unless
the
5
person
is
wearing
a
safety
helmet.
6
b.
A
person
shall
not
operate
a
motorcycle
or
motorized
7
bicycle
on
the
highways
accompanied
by
a
passenger
under
8
eighteen
years
of
age
unless
the
passenger
is
wearing
a
safety
9
helmet.

c.
For
purposes
of
this
subsection,
“wearing
a
safety
11
helmet”
means
having
a
safety
helmet
that
complies
with
the
12
standards
and
specifications
established
in
49
C.F.R.
§571.218
13
on
the
person’s
head
that
is
fastened
with
the
helmet
straps
14
and
that
is
of
a
size
that
fits
the
person’s
head
securely
15
without
excessive
lateral
or
vertical
movement.
The
department
16
shall
adopt
rules
pursuant
to
chapter
17A
establishing
17
guidelines
for
approved
safety
helmets
and
shall
maintain
and
18
publish
a
list
of
approved
safety
helmets.
The
list
need
not
19
be
inclusive.

The
inclusion
of
this
explanation

This
bill
prohibits
a
person
under
18
years
of
age
from

operating
a
motorcycle
or
motorized
bicycle
on
the
highways
29
unless
the
person
is
wearing
a
safety
helmet.
The
bill
also
30
prohibits
any
person
from
operating
a
motorcycle
or
motorized
31
bicycle
on
the
highways
accompanied
by
a
passenger
under
18
32
years
of
age
unless
the
passenger
is
wearing
a
safety
helmet.
33
The
bill
provides
that
a
violation
of
these
provisions
is
34
punishable
by
a
scheduled
fine
of
$50.

Under
the
bill,
“wearing
a
safety
helmet”
means
having

a
safety
helmet
that
complies
with
the
standards
and

specifications
established
in
the
Code
of
Federal
Regulations

on
the
person’s
head
that
is
fastened
with
the
helmet
straps

and
that
is
of
a
size
that
fits
the
person’s
head
securely

without
excessive

or
vertical
movement.

The
bill
updates
the
penalty
provision
to
exclude
references

to
subsections
in
Code
section
321.275
that
are
not
compatible
8
with
a
penalty,
including
a
statement
that
the
motor
vehicle
9
laws
apply
to
the
operators
of
motorcycles
and
motorized
10
bicycles
and
a
statement
that
the
provisions
of
Code
section
11
321.275
do
not
apply
to
motorcycles
or
motorized
bicycles
when
12
used
in
a
parade.
