vaccination

a
minor

1.
Unless
otherwise
specifically
provided
under
federal
or
4
state
law,
immunization
or
vaccination
of
a
minor
in
this
state
5
is
subject
to
prior
documented
consent
by
the
minor’s
parent
6
or
legal
guardian.

2.
For
the
purposes
of
this
section,
“minor”
means
a
person
8
who
has
not
attained
majority
as
described
in
section
599.1.

EXPLANATION
10
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
11
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
unless
otherwise
specifically
13
provided
under
federal
or
state
law,
immunization
or
14
vaccination
of
a
minor
in
this
state
is
subject
to
prior
15
documented
consent
by
the
minor’s
parent
or
legal
guardian.

The
bill
defines
“minor”
consistent
with
Code
section
599.1,
17
which
provides
that
the
period
of
minority
extends
to
the
age
18
of
18,
but
all
minors
attain
their
majority
by
marriage;
and
19
that
a
person
who
is
less
than
18
years
of
age
who
is
tried,
20
convicted,
and
sentenced
as
an
adult
and
committed
to
the
21
custody
of
the
director
of
the
department
of
corrections
shall
22
be
deemed
to
have
attained
the
age
of
majority
for
purposes
of
23
making
decisions
and
giving
consent
to
medical
care,
related
24
services,
and
treatment
during
the
period
of
the
person’s
25
incarceration.
