1.
NEW
SECTION
.
724.4D
Possession
or
carrying
of
1
dangerous
weapon
on
certain
property.

1.
A
person
carrying
or
possessing
a
dangerous
weapon,
3
whether
concealed
or
not,
shall
not
enter
upon
or
be
present
4
in
the
real
property
of
an
owner,
lessee,
or
person
in
lawful
5
possession
of
the
real
property
without
the
express
permission
6
of
the
owner,
lessee,
or
person
in
lawful
possession
of
the
7
real
property
if
a
printed
or
written
notice
forbidding
such
8
entry
has
been
conspicuously
posted
or
exhibited
at
the
main
9
entrance
to
the
real
property
or
the
forbidden
part
of
the
10
property.

2.
This
section
does
not
apply
to
the
following:
12
a.
A
person
listed
under
section
724.4,
subsection
4,
13
paragraphs
“a”
through
“d”
or
“j”
.

b.
A
person
who
has
been
specifically
authorized
by
the
15
owner,
lessee,
or
person
in
lawful
possession
of
the
real
16
property
to
carry
or
possess
a
dangerous
weapon
on
the
real
17
property.

A
person
who
violates
this
section
commits
a
simple
19
misdemeanor.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
carrying
or
possessing
a
dangerous
24
weapon
when
entering
real
property
if
a
written
notice
25
forbidding
such
entry
has
been
conspicuously
posted.

Under
the
bill,
a
person
carrying
or
possessing
a
dangerous
27
weapon,
whether
concealed
or
not,
shall
not
enter
upon
or
be
28
present
in
the
real
property
of
the
owner,
lessee,
or
person
29
in
lawful
possession
of
the
real
property
without
the
express
30
permission
of
the
owner,
lessee,
or
person
in
lawful
possession
31
of
the
real
property
if
a
printed
or
written
notice
forbidding
32
such
entry
has
been
conspicuously
posted
or
exhibited
at
the
33
main
entrance
to
the
property
or
the
forbidden
part
of
the
34
property.

The
following
persons
do
not
violate
the
bill:
a
person
who
1
goes
armed
with
a
dangerous
weapon
in
the
person’s
own
dwelling
2
or
place
of
business,
or
on
land
owned,
possessed,
or
rented
by
3
the
person;
a
person
who
has
been
specifically
authorized
by
4
the
owner,
lessee,
or
person
in
lawful
possession
of
the
real
5
property
to
carry
or
possess
a
dangerous
weapon
on
the
real
6
property;
a
peace
officer,
when
the
officer’s
duties
require
7
the
person
to
carry
a
dangerous
weapon;
a
member
of
the
armed
8
forces
when
the
weapons
are
carried
in
connection
with
the
9
person’s
duties;
a
correctional
officer,
when
the
officer’s
10
duties
require;
or
a
law
enforcement
officer
from
another
state
11
when
the
officer’s
duties
require
the
officer
to
carry
the
12
weapon
and
the
officer
is
in
this
state
for
official
duties.
13
A
“dangerous
weapon”
is
defined
in
Code
section
702.7.
14
A
person
who
violates
the
bill
commits
a
simple
misdemeanor
15
punishable
by
confinement
for
no
more
than
30
days
or
a
fine
of
16
at
least
$105
but
not
more
than
$855
or
by
both.
