Section
1.
NEW
SECTION
.
321.182A
Application
for
driver’s
1
license
or
nonoperator’s
identification
card
——
race
and
2
ethnicity.

1.
The
department
shall
request
that
a
person
who
applies
4
for
a
driver’s
license
or
nonoperator’s
identification
5
card
or
for
renewal
of
a
driver’s
license
or
nonoperator’s
6
identification
card
disclose
and
specify
the
person’s
race
or
7
ethnicity,
each
of
which
may
be
disclosed
and
specified
to
the
8
department
at
the
person’s
discretion.

2.
Prior
to
January
15,
2025,
and
prior
to
January
15
of
10
each
year
thereafter,
the
department
shall
submit
a
report
11
to
the
general
assembly
detailing
the
number
of
driver’s
12
license
and
nonoperator’s
identification
card
holders
who
13
have
disclosed
and
specified
a
race
or
ethnicity
pursuant
to
14
subsection
1.
15
3.
The
department
shall
electronically
maintain
as
part
16
of
a
person’s
record,
and
in
the
machine-readable
portion
of
17
the
driver’s
license
or
nonoperator’s
identification
card,
18
race
and
ethnicity
information
obtained
by
the
department,
but
19
shall
not
include
such
information
on
the
face
of
the
person’s
20
driver’s
license
or
nonoperator’s
identification
card.
Race
21
and
ethnicity
information
collected
by
the
department
shall
22
be
accessible
by
an
officer
or
employee
of
a
law
enforcement
23
agency
for
use
in
carrying
out
the
agency’s
functions
as
24
permitted
by
law,
but
shall
be
considered
confidential
25
information
and
is
not
a
public
record
or
otherwise
subject
26
to
disclosure
under
chapter
22.
The
department
shall
not
27
otherwise
release
race
and
ethnicity
information
collected
28
under
this
section
except
to
any
of
the
following:
29
a.
The
justice
advisory
board
established
in
section
30
216A.132.
31
b.
The
state
court
administrator
for
use
in
carrying
out
the
32
administrator’s
functions
as
permitted
by
law.
33
c.
The
division
of
criminal
and
juvenile
justice
planning
of
34
the
department
of
human
rights
for
use
in
research
activities

in
producing
statistical
reports
and
analysis
as
permitted

by
law.

4.
For
the
collection
of
race
and
ethnicity
information
3
pursuant
to
this
section,
the
department
shall
follow,
to
4
the
extent
practicable,
the
race
and
ethnicity
categories,
5
descriptors,
and
standards
utilized
by
the
United
States
census
6
bureau.

5.
The
department
may
adopt
rules
to
administer
this
8
section.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
11
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
self-identified
race
and
ethnicity
13
information
collected
with
an
application
for
a
driver’s
14
license
or
nonoperator’s
identification
card.
15
The
bill
provides
that
a
person
applying
for
a
driver’s
16
license
or
a
nonoperator’s
identification
card
will
be
17
requested
by
the
department
of
transportation
to
specify
the
18
person’s
race
or
ethnicity.
The
bill
requires
the
department
19
to
make
an
annual
report
to
the
general
assembly
regarding
20
the
number
of
persons
who
have
disclosed
and
specified
a
race
21
or
ethnicity.
Race
and
ethnicity
information
shall
only
be
22
released
to
a
law
enforcement
officer,
an
employee
of
a
law
23
enforcement
agency,
the
justice
advisory
board,
the
state
24
court
administrator,
and
the
division
of
criminal
and
juvenile
25
justice
planning
of
the
department
of
human
rights.
