Section 26.2, subsection 3, paragraph b, 1 subparagraph (3), Code 2024, is amended to read as follows: 2 (3) Emergency work or repair or maintenance work performed 3 by employees or agents of a governmental entity. 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 This bill revises the definition of a public improvement 8 for purposes of Code chapter 26 (public construction bidding) 9 to exclude emergency work, repair work, and maintenance work 10 performed by agents of a governmental entity. 11 By operation of law, the bill affects the term “public 12 improvement” as used in Code chapter 26A (guaranteed maximum 13 price contracts) and in Code sections 8.46 (lease-purchase 14 reporting); 260C.38 (community college lease-purchase 15 contracts); 278.1 (school district lease-purchase contracts); 16 297.7 (construction, renovation, and repair of school 17 buildings); 298.3 (school district levy revenue); 314.1B (bid 18 threshold subcommittees); 331.341 (county board of supervisors 19 contracts); 364.4 (city lease-purchase contracts); and 384.20 20 (city finance accounts). 21 -1- LSB 5307DP (1) 90 sc/js 1/ 1
