2 | | those retirees in enrolling in Social Security and Medicare. |
3 | | (b) The Program shall conduct an annual audit of the State |
4 | | Health Benefits Program for State of Illinois retirees for the |
5 | | purpose of identifying participants and their dependents who |
6 | | are eligible for Medicare under federal law. The Program shall |
7 | | also ensure that those retirees or their dependents who are |
8 | | eligible for Medicare are enrolled in Medicare with Medicare |
9 | | as their primary health care benefits coverage and the State |
10 | | Health Benefits Program being the secondary provider of their |
11 | | health care benefits coverage. |
12 | | (c) The Program shall assist any retiree or dependent who |
13 | | becomes disabled and is not enrolled in Social Security |
14 | | Disability Insurance and Medicare with enrolling in and |
15 | | obtaining Social Security Disability Insurance and Medicare |
16 | | benefits. This assistance shall include, but not be limited |
17 | | to: (i) developing communication materials to educate retirees |
18 | | about Social Security Disability Insurance benefits; (ii) |
19 | | performing multiple outreaches to targeted populations; (iii) |
20 | | analyzing responses to determine Social Security Disability |
21 | | Insurance eligibility; and (iv) representing qualified |
22 | | individuals on their claim for Social Security Disability |
23 | | Insurance and Medicare. |
24 | | (d) The administrator shall provide the Department, the |
25 | | State Employees Retirement System, and the General Assembly |
26 | | with an annual report showing the number of retirees and |

1 | | dependents who are transitioned to Social Security Disability |
2 | | Insurance and Medicare and the amount of savings realized by |
3 | | the State of Illinois.

4 | | Section 10. The Department of Healthcare and Family |
5 | | Services Law of the Civil Administrative Code of Illinois is |
6 | | amended by adding Section 2205-45 as follows:

7 | | (20 ILCS 2205/2205-45 new) |
8 | | Sec. 2205-45. Medicare Primacy Coordination Audit and |
9 | | Assistance Program. |
10 | | (a) Within 6 months after the effective date of this |
11 | | amendatory Act of the 103rd General Assembly, the Department |
12 | | of Healthcare and Family Services shall enter into a contract |
13 | | with a qualified and experienced administrator to establish |
14 | | and conduct a Medicare Primacy Coordination Audit and |
15 | | Assistance Program to identify Medicaid recipients who could |
16 | | benefit from Social Security Disability Insurance |
17 | | representation that could provide them with income and |
18 | | ultimately Medicare benefits. |
19 | | (b) The Program shall conduct an ongoing claims analysis |
20 | | of adults receiving Medicaid for the purpose of identifying |
21 | | high cost participants who may be eligible for Social Security |
22 | | Disability Insurance. |
23 | | (c) The Program shall assist any adult who claims |
24 | | disability and Social Security eligibility to apply for and be |

1 | | awarded Social Security Disability Insurance benefits and |
2 | | subsequently Medicare. This assistance shall include, but not |
3 | | be limited to: (i) developing communication materials to |

5 | | Insurance benefits; (ii) performing multiple outreaches to |
6 | | populations targeted by claims analysis; (iii) analyzing |
7 | | responses to determine Social Security Disability Insurance |
8 | | eligibility; and (iv) representing qualified individuals on |
9 | | their claim for Social Security Disability Insurance and |
10 | | Medicare. |
11 | | (d) The administrator shall provide the Department of |
12 | | Healthcare and Family Services and the General Assembly with |
13 | | an annual report showing the number of Medicaid recipients who |
14 | | have transitioned to Social Security Disability Insurance and |
15 | | Medicare and the amount of savings realized by the State of |
16 | | Illinois.
