AMENDMENT TO SENATE BILL 1171 


2 AMENDMENT NO. ______. Amend Senate Bill 1171 by replacing 
3everything after the enacting clause with the following:

4 "Section 5. The Department of Central Management Services 
5Law of the Civil Administrative Code of Illinois is amended by 
6adding Section 405-545 as follows:

7 (20 ILCS 405/405-545 new)
8 Sec. 405-545. State Retiree Medicare Primacy Coordination 
9Audit and Assistance Program.
10 (a) Within 6 months after the effective date of this 
11amendatory Act of the 103rd General Assembly, the Department 
12of Central Management Services, in conjunction with the State 
13Employees Retirement System, shall enter into a contract with 
14a qualified and experienced administrator to establish and 
15conduct a State Retiree Medicare Primacy Coordination Audit 
16and Assistance Program to identify retirees who are eligible

1for Medicare, but not enrolled in Medicare, and to assist 
2those retirees in enrolling in Social Security and Medicare.
3 (b) The Program shall conduct an annual audit of the State 
4Health Benefits Program for State of Illinois retirees for the 
5purpose of identifying participants and their dependents who 
6are eligible for Medicare under federal law. The Program shall 
7also ensure that those retirees or their dependents who are 
8eligible for Medicare are enrolled in Medicare with Medicare 
9as their primary health care benefits coverage and the State 
10Health Benefits Program being the secondary provider of their 
11health care benefits coverage.
12 (c) The Program shall assist any retiree or dependent who 
13becomes disabled and is not enrolled in Social Security 
14Disability Insurance and Medicare with enrolling in and 
15obtaining Social Security Disability Insurance and Medicare 
16benefits. This assistance shall include, but not be limited 
17to: (i) developing communication materials to educate retirees 
18about Social Security Disability Insurance benefits; (ii) 
19performing multiple outreaches to targeted populations; (iii) 
20analyzing responses to determine Social Security Disability 
21Insurance eligibility; and (iv) representing qualified 
22individuals on their claim for Social Security Disability 
23Insurance and Medicare.
24 (d) The administrator shall provide the Department, the 
25State Employees Retirement System, and the General Assembly 
26with an annual report showing the number of retirees and

1dependents who are transitioned to Social Security Disability 
2Insurance and Medicare and the amount of savings realized by 
3the State of Illinois.

4 Section 10. The Department of Healthcare and Family 
5Services Law of the Civil Administrative Code of Illinois is 
6amended by adding Section 2205-45 as follows:

7 (20 ILCS 2205/2205-45 new)
8 Sec. 2205-45. Medicare Primacy Coordination Audit and 
9Assistance Program.
10 (a) Within 6 months after the effective date of this 
11amendatory Act of the 103rd General Assembly, the Department 
12of Healthcare and Family Services shall enter into a contract 
13with a qualified and experienced administrator to establish 
14and conduct a Medicare Primacy Coordination Audit and 
15Assistance Program to identify Medicaid recipients who could 
16benefit from Social Security Disability Insurance 
17representation that could provide them with income and 
18ultimately Medicare benefits.
19 (b) The Program shall conduct an ongoing claims analysis 
20of adults receiving Medicaid for the purpose of identifying 
21high cost participants who may be eligible for Social Security 
22Disability Insurance.
23 (c) The Program shall assist any adult who claims 
24disability and Social Security eligibility to apply for and be

1awarded Social Security Disability Insurance benefits and 
2subsequently Medicare. This assistance shall include, but not 
3be limited to: (i) developing communication materials to 
4educate Medicaid recipients about Social Security Disability 
5Insurance benefits; (ii) performing multiple outreaches to 
6populations targeted by claims analysis; (iii) analyzing 
7responses to determine Social Security Disability Insurance 
8eligibility; and (iv) representing qualified individuals on 
9their claim for Social Security Disability Insurance and 
10Medicare.
11 (d) The administrator shall provide the Department of 
12Healthcare and Family Services and the General Assembly with 
13an annual report showing the number of Medicaid recipients who 
14have transitioned to Social Security Disability Insurance and 
15Medicare and the amount of savings realized by the State of 
16Illinois.
