Bill Title: Amends the Law Enforcement Officer-Worn Body Camera Act and the Law Enforcement Camera Grant Act, if and only if House Bill 3653 of the 101st General Assembly becomes law. Provides that notwithstanding any other provision of law, the Illinois Law Enforcement Training Standards Board shall administer grants under the Law Enforcement Camera Grant Act in accordance with rules adopted by the Board that prioritize law enforcement agencies in municipalities and counties under 50,000 that comply with the Illinois Police Training Act. Provides that the Board may adopt rules that prioritize the financial need of these agencies when determining eligibility for these grants under the Law Enforcement Camera Grant Act. Effective immediately.

3 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
4 | represented in the General Assembly:
| ||||||||||||||||||||||||||
5 | Section 5. If and only if House Bill 3653 of the 101st | ||||||||||||||||||||||||||
6 | General Assembly becomes law, the Law Enforcement Officer-Worn | ||||||||||||||||||||||||||
7 | Body Camera Act is amended by changing Section 10-15 as | ||||||||||||||||||||||||||
8 | follows:

10 | Sec. 10-15. Applicability. | ||||||||||||||||||||||||||
11 | (a) All law enforcement agencies must employ the use of | ||||||||||||||||||||||||||
12 | officer-worn body cameras in accordance with the provisions of | ||||||||||||||||||||||||||
13 | this Act, whether or not the agency receives or has received | ||||||||||||||||||||||||||
14 | monies from the Law Enforcement Camera Grant Fund.

15 | (b) All law enforcement agencies must implement the use of | ||||||||||||||||||||||||||
16 | body cameras for all law enforcement officers, according to | ||||||||||||||||||||||||||
17 | the following schedule: | ||||||||||||||||||||||||||
18 | (1) for municipalities and counties with populations | ||||||||||||||||||||||||||
19 | of 500,000 or more, body cameras shall be implemented by | ||||||||||||||||||||||||||
20 | January 1, 2022; | ||||||||||||||||||||||||||
21 | (2) for municipalities and counties with populations | ||||||||||||||||||||||||||
22 | of 100,000 or more but under 500,000, body cameras shall | ||||||||||||||||||||||||||
23 | be implemented by January 1, 2023; |

1 | (3) for municipalities and counties with populations | ||||||
2 | of 50,000 or more but under 100,000, body cameras shall be | ||||||
3 | implemented by January 1, 2024; | ||||||
4 | (4) for municipalities and counties under 50,000, body | ||||||
5 | cameras shall be implemented by January 1, 2025 , subject | ||||||
6 | to the provisions of Section 11 of the Law Enforcement | ||||||
7 | Camera Grant Act ; and | ||||||
8 | (5) for the Department of State Police, body cameras | ||||||
9 | shall be implemented by January 1, 2025. | ||||||
10 | (c) A law enforcement agency's compliance with the | ||||||
11 | requirements under this Section shall receive preference by | ||||||
12 | the Illinois Law Enforcement Training Standards Board in | ||||||
13 | awarding grant funding under the Law Enforcement Camera Grant | ||||||
14 | Act. | ||||||

16 | Section 10. If and only if House Bill 3653 of the 101st | ||||||
17 | General Assembly becomes law, the Law Enforcement Camera Grant | ||||||
18 | Act is amended by adding Section 11 as follows:

20 | Sec. 11. Officer-worn body cameras; implementation. | ||||||
21 | Notwithstanding any other provision of law, the Board shall | ||||||
22 | administer grants under this Act in accordance with rules | ||||||
23 | adopted by the Board that prioritize law enforcement agencies | ||||||
24 | under paragraph (4) of subsection (b) of Section 10-15 of the |

1 | Law Enforcement Officer-Worn Body Camera Act that comply with | ||||||
2 | the Illinois Police Training Act. The Board may adopt rules | ||||||
3 | that prioritize the financial need of these agencies when | ||||||

5 | 20 of this Act.

6 | Section 99. Effective date. This Act takes effect upon | ||||||
7 | becoming law.
