SYNOPSIS AS INTRODUCED:

Amends the Illinois Lottery Law. Provides that the Department of the Lottery shall offer a joint special instant scratch-off game for the benefit of the special causes of: the Carolyn Adams Ticket For The Cure; the Scratch-off for Illinois veterans; the Scratch-out Multiple Sclerosis scratch-off game; the Quality of Life scratch-off game; the Go For The Gold scratch-off game; the Scratch-off for State police memorials; the Scratch-off for homelessness prevention programs; the Scratch-off for Alzheimer's care, support, education, and awareness; the Scratch-off for United Negro College Fund Illinois; and the Illinois DREAM scratch-off. Provides that the joint special instant scratch-off game shall commence on January 1, 2024 or as soon thereafter, at the discretion of the Director of the Department of Lottery, as is reasonably practical. Provides that once the joint special instant scratch-off game is used to fund a special cause, the game will be used to fund the special cause for the remainder of the special causes' existence per the causes' respective provision. Provides that new specialty tickets and causes authorized by this Law shall be funded by the joint special instant scratch-off game. Provides that the Department shall be limited to supporting no more than 10 causes in total at any given time. Repeals a provision regarding the scratch-off game for school STEAM programs. Creates the scratch-off for United Negro College Fund Illinois. Provides that the UNCF Scholarship Fund is created as a special fund in the State treasury. Creates the Illinois DREAM scratch-off. Provides that the Illinois DREAM Fund is created as a special fund in the State treasury. Makes other changes and conforming changes in the State Finance Act and the Higher Education Assistance Act. Effective immediately.

1 AN ACT concerning gaming.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Lottery Law is amended by changing
5Sections 9.3, 20, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11,
6and 21.13 and by adding Sections 21.4, 21.15, and 21.16 as
7follows:

9 Sec. 9.3. Expenditure and distribution of lottery
10proceeds.
11 (a) Beginning July 1, 2022, except as provided in Sections
1221.4, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.12, and
1321.13, 21.15, and 21.16 of this Act and Section 25-70 of the
14Sports Wagering Act, the Department shall distribute all
15proceeds of lottery tickets and shares sold in the following
16priority and manner:
17 (1) The payment of prizes and retailer bonuses.
18 (2) The payment of costs incurred in the operation and
19 administration of the Lottery, including the payment of
20 sums due to the private manager under the management
21 agreement with the Department and including costs of
22 administering the Lottery sports wagering program pursuant
23 to Section 25-70 of the Sports Wagering Act.

1 (3) On the last day of each month or as soon thereafter
2 as possible, the State Comptroller shall direct and the
3 State Treasurer shall transfer from the State Lottery Fund
4 to the Common School Fund the Department's estimate of net
5 lottery proceeds.
6 (4) If an amount in excess of the annual net lottery
7 proceeds is transferred for a fiscal year, then the
8 Department shall offset the monthly transfers of estimated
9 net lottery proceeds during the following fiscal year by
10 that excess amount. If an amount less than the annual net
11 lottery proceeds is transferred for a fiscal year, then
12 after the related annual fiscal year audit is completed
13 following such fiscal year, the Department shall direct
14 the deposit of any remaining annual net lottery proceeds
15 from such fiscal year, subject to payments under
16 paragraphs (1) and (2), into the Common School Fund as
17 soon thereafter as possible.
18 (b) The net lottery proceeds shall be determined by
19deducting from total annual lottery proceeds the expenditures
20required by paragraphs (1) and (2) of subsection (a). The
21total annual lottery proceeds and annual net lottery proceeds
22shall be determined according to generally accepted accounting
23principles for governmental entities and verified by an annual
24fiscal year audit.

2 Sec. 20. State Lottery Fund.
3 (a) There is created in the State Treasury a special fund
4to be known as the State Lottery Fund. Such fund shall consist
5of all revenues received from (1) the sale of lottery tickets
6or shares, (net of commissions, fees representing those
7expenses that are directly proportionate to the sale of
8tickets or shares at the agent location, and prizes of less
9than $600 which have been validly paid at the agent level), (2)
10application fees, and (3) all other sources including moneys
11credited or transferred thereto from any other fund or source
12pursuant to law. Interest earnings of the State Lottery Fund
13shall be credited to the Common School Fund.
14 (a-5) The receipt and distribution of moneys under Section
1521.4 of this Act shall be in accordance with Section 21.4.
16 (b) The receipt and distribution of moneys under Section
1721.5 of this Act shall be in accordance with Section 21.5.
18 (c) The receipt and distribution of moneys under Section
1921.6 of this Act shall be in accordance with Section 21.6.
20 (d) The receipt and distribution of moneys under Section
2121.7 of this Act shall be in accordance with Section 21.7.
22 (e) The receipt and distribution of moneys under Section
2321.8 of this Act shall be in accordance with Section 21.8.
24 (f) The receipt and distribution of moneys under Section
2521.9 of this Act shall be in accordance with Section 21.9.
26 (g) The receipt and distribution of moneys under Section

121.10 of this Act shall be in accordance with Section 21.10.
2 (h) The receipt and distribution of moneys under Section
321.11 of this Act shall be in accordance with Section 21.11.

5Section 21.12 of this Act shall be in accordance with Section
621.12.
7 (j) The receipt and distribution of moneys under Section
821.13 of this Act shall be in accordance with Section 21.13.
9 (k) The receipt and distribution of moneys under Section
1025-70 of the Sports Wagering Act shall be in accordance with
11Section 25-70 of the Sports Wagering Act.
12 (l) The receipt and distribution of moneys under Section
1321.15 of this Act shall be in accordance with Section 21.15.
14 (m) The receipt and distribution of moneys under Section
1521.16 of this Act shall be in accordance with Section 21.16.

19 Sec. 21.4. Joint Special Instant Scratch-off game.
20 (a) The Department shall offer a joint special instant
21scratch-off game for the benefit of the special causes
22identified in Sections 21.5, 21.6, 21.7, 21.8, 21.9, 21.10,
2321.11, 21.13, 21.15, and 21.16. The operation of the game
24shall be governed by this Section and any rules adopted by the
25Department. The game shall commence on January 1, 2024 or as

1soon thereafter, at the discretion of the Director, as is
2reasonably practical. If any provision of this Section is
3inconsistent with any other provision in the Act, then this
4Section governs.
5 (b) Once the joint special instant scratch-off game is
6used to fund a special cause, the game will be used to fund the
7special cause for the remainder of the special causes'
8existence per the causes' respective Section of this Act.
9 (c) New specialty tickets and causes authorized by this
10Act shall be funded by the joint special instant scratch-off
11game. New specialty tickets and causes after February 1, 2024
12must have a sunset date. The Department shall be limited to
13supporting no more than 10 causes in total at any given time.
14 (d) Net revenue received from the sale of the joint
15special instant scratch-off game for the purposes of this
16Section shall be divided equally among the special causes the
17game benefits. The Department shall transfer the net revenue
18into the special fund identified for each special cause in
19accordance with the special cause's respective Section of this
20Act. As used in this Section, "net revenue" means the total
21amount for which tickets have been sold less the sum of the
22amount paid out in prizes and to retailers, and direct and
23estimated administrative expenses incurred in operation of the
24ticket.

1 Sec. 21.5. Carolyn Adams Ticket For The Cure.
2 (a) The Department shall offer a special instant
3scratch-off game with the title of "Carolyn Adams Ticket For
4The Cure". The game shall commence on January 1, 2006 or as
5soon thereafter, in the discretion of the Director, as is
6reasonably practical, and shall be discontinued on December
731, 2026. The operation of the game shall be governed by this
8Act and any rules adopted by the Department. The Department
9must consult with the Carolyn Adams Ticket For The Cure Board,
10which is established under Section 2310-347 of the Department
11of Public Health Powers and Duties Law of the Civil
12Administrative Code of Illinois, regarding the design and
13promotion of the game. If any provision of this Section is
14inconsistent with any other provision of this Act, then this
15Section governs.
16 (b) The Carolyn Adams Ticket For The Cure Grant Fund is
17created as a special fund in the State treasury. The net
18revenue from the Carolyn Adams Ticket For The Cure special
19instant scratch-off game shall be deposited into the Fund for
20appropriation by the General Assembly solely to the Department
21of Public Health for the purpose of making grants to public or
22private entities in Illinois for the purpose of funding breast
23cancer research, and supportive services for breast cancer
24survivors and those impacted by breast cancer and breast
25cancer education. In awarding grants, the Department of Public
26Health shall consider criteria that includes, but is not

1limited to, projects and initiatives that address disparities
2in incidence and mortality rates of breast cancer, based on
3data from the Illinois Cancer Registry, and populations facing
4barriers to care. The Department of Public Health shall,
5before grants are awarded, provide copies of all grant
6applications to the Carolyn Adams Ticket For The Cure Board,
7receive and review the Board's recommendations and comments,
8and consult with the Board regarding the grants. For purposes
9of this Section, the term "research" includes, without
10limitation, expenditures to develop and advance the
11understanding, techniques, and modalities effective in the
12detection, prevention, screening, and treatment of breast
13cancer and may include clinical trials. The grant funds may
14not be used for institutional, organizational, or
15community-based overhead costs, indirect costs, or levies.
16 Moneys received for the purposes of this Section,
17including, without limitation, net revenue from the special
18instant scratch-off game and gifts, grants, and awards from
19any public or private entity, must be deposited into the Fund.
20Any interest earned on moneys in the Fund must be deposited
21into the Fund.
22 As used in this subsection, For purposes of this
23subsection, "net revenue" means the total amount for which
24tickets have been sold less the sum of the amount paid out in
25prizes and to retailers, and direct and estimated the actual
26administrative expenses of the Department solely related to

1the Ticket For The Cure game.
2 (c) During the time that tickets are sold for the Carolyn
3Adams Ticket For The Cure game, the Department shall not
4unreasonably diminish the efforts devoted to marketing any
5other instant scratch-off lottery game.
6 (d) The Department may adopt any rules necessary to
7implement and administer the provisions of this Section.

10 Sec. 21.6. Scratch-off for Illinois veterans.
11 (a) The Department shall offer a special instant
12scratch-off game for the benefit of Illinois veterans. The
13game shall commence on January 1, 2006 or as soon thereafter,
14at the discretion of the Director, as is reasonably practical.
15The operation of the game shall be governed by this Act and any
16rules adopted by the Department. If any provision of this
17Section is inconsistent with any other provision of this Act,
18then this Section governs.
19 (b) The Illinois Veterans Assistance Fund is created as a
20special fund in the State treasury. The net revenue from the
21Illinois veterans scratch-off game shall be deposited into the
22Fund for appropriation by the General Assembly solely to the
23Department of Veterans' Affairs for making grants, funding
24additional services, or conducting additional research
25projects relating to each of the following:

1 (i) veterans' behavioral health services;
2 (ii) veterans' homelessness;
3 (iii) the health insurance costs of veterans;
4 (iv) veterans' disability benefits, including but not
5 limited to, disability benefits provided by veterans
6 service organizations and veterans assistance commissions
7 or centers;
8 (v) the long-term care of veterans; provided that,
9 beginning with moneys appropriated for fiscal year 2008,
10 no more than 20% of such moneys shall be used for health
11 insurance costs;
12 (vi) veteran employment and employment training; and
13 (vii) veterans' emergency financial assistance,
14 including, but not limited to, past due utilities,
15 housing, and transportation costs.
16 In order to expend moneys from this special fund,
17beginning with moneys appropriated for fiscal year 2008, the
18Director of Veterans' Affairs shall appoint a 3-member funding
19authorization committee. The Director shall designate one of
20the members as chairperson. The committee shall meet on a
21quarterly basis, at a minimum, and shall authorize expenditure
22of moneys from the special fund by a two-thirds vote.
23Decisions of the committee shall not take effect unless and
24until approved by the Director of Veterans' Affairs. Each
25member of the committee shall serve until a replacement is
26named by the Director of Veterans' Affairs. One member of the

1committee shall be a member of the Veterans' Advisory Council.
2 Moneys collected from the special instant scratch-off game
3shall be used only as a supplemental financial resource and
4shall not supplant existing moneys that the Department of
5Veterans' Affairs may currently expend for the purposes set
6forth in items (i) through (v).
7 Moneys received for the purposes of this Section,
8including, without limitation, net revenue from the special
9instant scratch-off game and from gifts, grants, and awards
10from any public or private entity, must be deposited into the
11Fund. Any interest earned on moneys in the Fund must be
12deposited into the Fund.
13 As used in this subsection, For purposes of this
14subsection, "net revenue" means the total amount for which
15tickets have been sold less the sum of the amount paid out in
16the prizes and to retailers, and direct and estimated the
17actual administrative expenses of the Department solely
18related to the scratch-off game under this Section.
19 (c) During the time that tickets are sold for the Illinois
20veterans scratch-off game, the Department shall not
21unreasonably diminish the efforts devoted to marketing any
22other instant scratch-off lottery game.
23 (d) The Department may adopt any rules necessary to
24implement and administer the provisions of this Section.

2 Sec. 21.7. Scratch-out Multiple Sclerosis scratch-off
3game.
4 (a) The Department shall offer a special instant
5scratch-off game for the benefit of research pertaining to
6multiple sclerosis. The game shall commence on July 1, 2008 or
7as soon thereafter, in the discretion of the Director, as is
8reasonably practical. The operation of the game shall be
9governed by this Act and any rules adopted by the Department.
10If any provision of this Section is inconsistent with any
11other provision of this Act, then this Section governs.
12 (b) The Multiple Sclerosis Research Fund is created as a
13special fund in the State treasury. The net revenue from the
14scratch-out multiple sclerosis scratch-off game created under
15this Section shall be deposited into the Fund for
16appropriation by the General Assembly to the Department of
17Public Health for the purpose of making grants to
18organizations in Illinois that conduct research pertaining to
19the repair and prevention of damage caused by an acquired
20demyelinating disease of the central nervous system.
21 Moneys received for the purposes of this Section,
22including, without limitation, net revenue from the special
23instant scratch-off game and from gifts, grants, and awards
24from any public or private entity, must be deposited into the
25Fund. Any interest earned on moneys in the Fund must be
26deposited into the Fund.

1 For purposes of this Section, the term "research"
2includes, without limitation, expenditures to develop and
3advance the understanding, techniques, and modalities
4effective for maintaining function, mobility, and strength
5through preventive physical therapy or other treatments and to
6develop and advance the repair, and also the prevention, of
7myelin, neuron, and axon damage caused by an acquired
8demyelinating disease of the central nervous system and the
9restoration of function, including but not limited to, nervous
10system repair or neuroregeneration.
11 The grant funds may not be used for institutional,
12organizational, or community-based overhead costs, indirect
13costs, or levies.
14 As used in this subsection, For purposes of this
15subsection, "net revenue" means the total amount for which
16tickets have been sold less the sum of the amount paid out in
17the prizes and to retailers, and direct and estimated the
18actual administrative expenses of the Department solely
19related to the scratch-off game under this Section.
20 (c) During the time that tickets are sold for the
21scratch-out multiple sclerosis scratch-off game, the
22Department shall not unreasonably diminish the efforts devoted
23to marketing any other instant scratch-off lottery game.
24 (d) The Department may adopt any rules necessary to
25implement and administer the provisions of this Section.

2 Sec. 21.8. Quality of Life scratch-off game.
3 (a) The Department shall offer a special instant
4scratch-off game with the title of "Quality of Life". The game
5shall commence on July 1, 2007 or as soon thereafter, in the
6discretion of the Director, as is reasonably practical, and
7shall be discontinued on December 31, 2025. The operation of
8the game is governed by this Act and by any rules adopted by
9the Department. The Department must consult with the Quality
10of Life Board, which is established under Section 2310-348 of
11the Department of Public Health Powers and Duties Law of the
12Civil Administrative Code of Illinois, regarding the design
13and promotion of the game. If any provision of this Section is
14inconsistent with any other provision of this Act, then this
15Section governs.
16 (b) The Quality of Life Endowment Fund is created as a
17special fund in the State treasury. The net revenue from the
18Quality of Life special instant scratch-off game must be
19deposited into the Fund for appropriation by the General
20Assembly solely to the Department of Public Health for the
21purpose of HIV/AIDS-prevention education and for making grants
22to public or private entities in Illinois for the purpose of
23funding organizations that serve the highest at-risk
24categories for contracting HIV or developing AIDS. Grants
25shall be targeted to serve at-risk populations in proportion

1to the distribution of recent reported Illinois HIV/AIDS cases
2among risk groups as reported by the Illinois Department of
3Public Health. The recipient organizations must be engaged in
4HIV/AIDS-prevention education and HIV/AIDS healthcare
5treatment. The Department must, before grants are awarded,
6provide copies of all grant applications to the Quality of
7Life Board, receive and review the Board's recommendations and
8comments, and consult with the Board regarding the grants.
9Organizational size will determine an organization's
10competitive slot in the "Request for Proposal" process.
11Organizations with an annual budget of $300,000 or less will
12compete with like size organizations for 50% of the Quality of
13Life annual fund. Organizations with an annual budget of
14$300,001 to $700,000 will compete with like organizations for
1525% of the Quality of Life annual fund, and organizations with
16an annual budget of $700,001 and upward will compete with like
17organizations for 25% of the Quality of Life annual fund. The
18lottery may designate a percentage of proceeds for marketing
19purposes. The grant funds may not be used for institutional,
20organizational, or community-based overhead costs, indirect
21costs, or levies.
22 Grants awarded from the Fund are intended to augment the
23current and future State funding for the prevention and
24treatment of HIV/AIDS and are not intended to replace that
25funding.
26 Moneys received for the purposes of this Section,

1including, without limitation, net revenue from the special
2instant scratch-off game and gifts, grants, and awards from
3any public or private entity, must be deposited into the Fund.
4Any interest earned on moneys in the Fund must be deposited
5into the Fund.
6 As used in this subsection, For purposes of this
7subsection, "net revenue" means the total amount for which
8tickets have been sold less the sum of the amount paid out in
9prizes and to retailers, and direct and estimated the actual
10administrative expenses of the Department solely related to
11the Quality of Life game.
12 (c) During the time that tickets are sold for the Quality
13of Life game, the Department shall not unreasonably diminish
14the efforts devoted to marketing any other instant scratch-off
15lottery game.
16 (d) The Department may adopt any rules necessary to
17implement and administer the provisions of this Section in
18consultation with the Quality of Life Board.

21 Sec. 21.9. Go For The Gold scratch-off game.
22 (a) The Department shall offer a special instant
23scratch-off game with the title of "Go For The Gold". The game
24must commence on July 1, 2014 or as soon thereafter, at the
25discretion of the Director, as is reasonably practical. The

1operation of the game is governed by this Act and by any rules
2adopted by the Department. If any provision of this Section is
3inconsistent with any other provision of this Act, then this
4Section governs.
5 (b) The Special Olympics Illinois and Special Children's
6Charities Fund is created as a special fund in the State
7treasury. The net revenue from the Go For The Gold special
8instant scratch-off game must be deposited into the Special
9Olympics Illinois and Special Children's Charities Fund for
10appropriation by the General Assembly solely to the Department
11of Human Services, which must distribute the moneys as
12follows: (i) 75% of the moneys to Special Olympics Illinois to
13support the statewide training, competitions, and programs for
14future Special Olympics athletes; and (ii) 25% of the moneys
15to Special Children's Charities to support the City of
16Chicago-wide training, competitions, and programs for future
17Special Olympics athletes. The moneys may not be used for
18institutional, organizational, or community-based overhead
19costs, indirect costs, or levies.
20 Moneys received for the purposes of this Section,
21including, without limitation, net revenue from the special
22instant scratch-off game and gifts, grants, and awards from
23any public or private entity, must be deposited into the
24Special Olympics and Special Children's Charities Fund. Any
25interest earned on moneys in the Special Olympics and Special
26Children's Charities Fund must be deposited into the Special

1Olympics and Special Children's Charities Fund.
2 As used in this subsection, For purposes of this
3subsection, "net revenue" means the total amount for which
4tickets have been sold less the sum of the amount paid out in
5prizes and to retailers, and direct and estimated the actual
6administrative expenses of the Department solely related to
7the Go For The Gold game.
8 (c) During the time that tickets are sold for the Go For
9The Gold game, the Department shall not unreasonably diminish
10the efforts devoted to marketing any other instant scratch-off
11lottery game.
12 (d) The Department may adopt any rules necessary to
13implement and administer the provisions of this Section.

16 Sec. 21.10. Scratch-off for State police memorials.
17 (a) The Department shall offer a special instant
18scratch-off game for the benefit of State police memorials.
19The game shall commence on January 1, 2019 or as soon
20thereafter, at the discretion of the Director, as is
21reasonably practical. The operation of the game shall be
22governed by this Act and any rules adopted by the Department.
23If any provision of this Section is inconsistent with any
24other provision of this Act, then this Section governs.
25 (b) The net revenue from the State police memorials

1scratch-off game shall be deposited into the Criminal Justice
2Information Projects Fund and distributed equally, as soon as
3practical but at least on a monthly basis, to the Chicago
4Police Memorial Foundation Fund, the Police Memorial Committee
5Fund, and the Illinois State Police Memorial Park Fund. Moneys
6transferred to the funds under this Section shall be used,
7subject to appropriation, to fund grants for building and
8maintaining memorials and parks; holding annual memorial
9commemorations; giving scholarships to children of officers
10killed or catastrophically injured in the line of duty, or
11those interested in pursuing a career in law enforcement;
12providing financial assistance to police officers and their
13families when a police officer is killed or injured in the line
14of duty; and providing financial assistance to officers for
15the purchase or replacement of bulletproof vests to be used in
16the line of duty.
17 As used in this subsection, For purposes of this
18subsection, "net revenue" means the total amount for which
19tickets have been sold less the sum of the amount paid out in
20the prizes and to retailers, and direct and estimated the
21actual administrative expenses of the Department solely
22related to the scratch-off game under this Section.
23 (c) During the time that tickets are sold for the State
24police memorials scratch-off game, the Department shall not
25unreasonably diminish the efforts devoted to marketing any
26other instant scratch-off lottery game.

1 (d) The Department may adopt any rules necessary to
2implement and administer the provisions of this Section.

5 Sec. 21.11. Scratch-off for homelessness prevention
6programs.
7 (a) The Department shall offer a special instant
8scratch-off game to fund homelessness prevention programs. The
9game shall commence on July 1, 2019 or as soon thereafter, at
10the discretion of the Director, as is reasonably practical.
11The operation of the game shall be governed by this Act and any
12rules adopted by the Department. If any provision of this
13Section is inconsistent with any other provision of this Act,
14then this Section governs.
15 (b) The Homelessness Prevention Revenue Fund is created as
16a special fund in the State treasury. The net revenue from the
17scratch-off game to fund homelessness prevention programs
18shall be deposited into the Homelessness Prevention Revenue
19Fund. Subject to appropriation, moneys in the Fund shall be
20used by the Department of Human Services solely for grants to
21homelessness prevention and assistance projects under the
22Homelessness Prevention Act.
23 As used in this subsection, "net revenue" means the total
24amount for which tickets have been sold less the sum of the
25amount paid out in the prizes and to retailers, and direct and

1estimated the actual administrative expenses of the Department
2solely related to the scratch-off game under this Section.
3 (c) During the time that tickets are sold for the
4scratch-off game to fund homelessness prevention programs, the
5Department shall not unreasonably diminish the efforts devoted
6to marketing any other instant scratch-off lottery game.
7 (d) The Department may adopt any rules necessary to
8implement and administer the provisions of this Section.
9 (e) Nothing in this Section shall be construed to affect
10any revenue that any Homelessness Prevention line item
11receives through the General Revenue Fund or the Illinois
12Affordable Housing Trust Fund.

15 Sec. 21.13. Scratch-off for Alzheimer's care, support,
16education, and awareness.
17 (a) The Department shall offer a special instant
18scratch-off game for the benefit of Alzheimer's care, support,
19education, and awareness. The game shall commence on January
201, 2020 or as soon thereafter, at the discretion of the
21Director, as is reasonably practical, and shall be
22discontinued on January 1, 2025. The operation of the game
23shall be governed by this Act and any rules adopted by the
24Department. If any provision of this Section is inconsistent
25with any other provision of this Act, then this Section

2 (b) The net revenue from the Alzheimer's care, support,
3education, and awareness scratch-off game shall be deposited
4into the Alzheimer's Awareness Fund.
5 Moneys received for the purposes of this Section,
6including, without limitation, net revenue from the special
7instant scratch-off game and from gifts, grants, and awards
8from any public or private entity, must be deposited into the
9Fund. Any interest earned on moneys in the Fund must be
10deposited into the Fund.
11 As used in this subsection, For the purposes of this
12subsection, "net revenue" means the total amount for which
13tickets have been sold less the sum of the amount paid out in
14the prizes and to retailers, and direct and estimated the
15actual administrative expenses of the Department solely
16related to the scratch-off game under this Section.
17 (c) During the time that tickets are sold for the
18Alzheimer's care, support, education, and awareness
19scratch-off game, the Department shall not unreasonably

3Illinois.
4 (a) The Department shall offer a special instant
5scratch-off game for the benefit of United Negro College Fund
6Illinois in support of educational scholarships to university
7and college students. The game shall commence on January 1,
82024 or as soon thereafter, at the discretion of the Director,
9as is reasonably practical. The operation of the game shall be
10governed by this Act and any rules adopted by the Department.
11The Department must consult with UNCF Illinois regarding the
12design and promotion of the game.
13 (b) The UNCF Scholarship Fund is created as a special fund
14in the State treasury. The net revenue from the special
15instant scratch-off game sold for the benefit of the United
16Negro College Fund Illinois in support of education
17scholarships to university and college students shall be
18deposited into the fund for appropriation by the General
19Assembly solely to the Student Assistance Commission for the
20purpose of funding UNCF Illinois Scholarship awards to
21university and college students. Funding shall be used solely
22for scholarship awards and not to cover any administrative
23costs of the United Negro College Fund, Inc., a 501(c)(3)
24nonprofit recipient organization.
25 Moneys received for the purposes of this Section,
26including, without limitation, net revenue from the special

19 Sec. 21.16. Illinois DREAM scratch-off.
20 (a) The Department shall offer a special Illinois DREAM
21instant scratch-off game for the benefit of the Illinois DREAM
22Fund Commission. The new revenue from the Illinois DREAM
23scratch-off game shall be deposited into the Illinois DREAM
24Fund, a special fund that is created in the State treasury.
25Subject to appropriation, money in the Illinois DREAM Fund

1shall be used to assist in funding scholarships and other
2statutory responsibilities of the Illinois DREAM Fund
3Commission. The game shall commence on January 1, 2024 or as
4soon thereafter as is reasonably practical. The Department
5shall consult with the Illinois DREAM Fund Commission
6established under Section 67 of the Higher Education Student
7Assistance Act regarding the design and promotion of the game.
8 (b) The operation of any games under this Section shall be
9governed by this Act, and any rules shall be adopted by the
10Department.
11 (c) For purposes of this Section, "net revenue" means the
12total amount for which tickets have been sold less the sum of
13the amount paid out in prizes and the actual administrative
14expenses of the Department solely related to the Illinois
15DREAM scratch-off game.
16 (d) During the time that tickets are sold for the Illinois
17DREAM scratch-off game, the Department shall not unreasonably
18diminish the efforts devoted to marketing any other instant
19scratch-off lottery game.
20 (e) The Department may adopt any rules necessary to
21implement and administer this Section in consultation with the
22Illinois DREAM Fund Commission.

10 Sec. 67. Illinois DREAM Fund Commission.
11 (a) The Illinois Student Assistance Commission shall
12establish an Illinois DREAM Fund Commission. The Governor
13shall appoint, with the advice and consent of the Senate,
14members to the Illinois DREAM Fund Commission, which shall be
15comprised of 9 members representing the geographic and ethnic
16diversity of this State, including students, college and
17university administrators and faculty, and other individuals
18committed to advancing the educational opportunities of the
19children of immigrants.
20 (b) The Illinois DREAM Fund Commission is charged with all
21of the following responsibilities:

1 (1) Administering this Section and raising funds for
2 the Illinois DREAM Fund.
3 (2) Establishing a not-for-profit entity charged with
4 raising funds for the administration of this Section, any
5 educational or training programs the Commission is tasked
6 with administering, and funding scholarships to students
7 who are the children of immigrants to the United States.
8 (3) Publicizing the availability of scholarships from
9 the Illinois DREAM Fund.
10 (4) Selecting the recipients of scholarships funded
11 through the Illinois DREAM Fund.
12 (5) Researching issues pertaining to the availability
13 of assistance with the costs of higher education for the
14 children of immigrants and other issues regarding access
15 for and the performance of the children of immigrants
16 within higher education.
17 (6) Overseeing implementation of the other provisions
18 of this amendatory Act of the 97th General Assembly.
19 (7) Establishing and administering training programs
20 for high school counselors and counselors, admissions
21 officers, and financial aid officers of public
22 institutions of higher education. The training programs
23 shall instruct participants on the educational
24 opportunities available to college-bound students who are
25 the children of immigrants, including, but not limited to,
26 in-state tuition and scholarship programs. The Illinois

1 DREAM Fund Commission may also establish a public
2 awareness campaign regarding educational opportunities
3 available to college bound students who are the children
4 of immigrants.
5 The Illinois DREAM Fund Commission shall establish, by
6rule, procedures for accepting and evaluating applications for
7scholarships from the children of immigrants and issuing
8scholarships to selected student applicants.
9 (c) To receive a scholarship under this Section, a student
10must meet all of the following qualifications:
11 (1) Have resided with his or her parents or guardian
12 while attending a public or private high school in this
13 State.
14 (2) Have graduated from a public or private high
15 school or received the equivalent of a high school diploma
16 in this State.
17 (3) Have attended school in this State for at least 3
18 years as of the date he or she graduated from high school
19 or received the equivalent of a high school diploma.
20 (4) Have at least one parent who immigrated to the
21 United States.
22 (d) The Illinois Student Assistance Commission shall
23establish an Illinois DREAM Fund to provide scholarships under
24this Section. The Illinois DREAM Fund shall be funded entirely
25from private contributions, gifts, grants, awards, and
26proceeds from the scratch-off created in Section 21.16 of the
