1 | AN ACT concerning local government.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Sanitary District Act of 1936 is amended by | ||||||
5 | adding Section 37.1 as follows:
| ||||||
6 | (70 ILCS 2805/37.1 new) | ||||||
7 | Sec. 37.1. Dissolution of district with no employees and no | ||||||
8 | bond indebtedness; winding up sanitary district business; tax | ||||||
9 | by acquiring municipalities. | ||||||
10 | (a) Any sanitary district created under this Act which is | ||||||
11 | located in a county having a population of 3,000,000 or more, | ||||||
12 | which is wholly included in three or more municipalities, which | ||||||
13 | no part is included in any unincorporated area, which has no | ||||||
14 | employees, and which has no revenue bond indebtedness shall, | ||||||
15 | upon the effective date of this amendatory Act of the 99th | ||||||
16 | General Assembly, be dissolved by operation of law. Each of the | ||||||
17 | municipalities within the territory of a dissolved sanitary | ||||||
18 | district shall be responsible for providing sewers for | ||||||
19 | collecting and disposing of sewage. | ||||||
20 | (b) The officers of any dissolved sanitary district | ||||||
21 | immediately preceding the effective date of this amendatory Act | ||||||
22 | of the 99th General Assembly shall close up the business | ||||||
23 | affairs of the sanitary district by conveying title of a |

1 | dissolved sanitary district's property to the municipalities | ||||||
2 | collecting and disposing of sewage and by liquidating any | ||||||
3 | remaining personal property of a dissolved sanitary district. | ||||||
4 | After all the debts and obligations of the dissolved sanitary | ||||||
5 | district have been satisfied, any remaining monies shall be | ||||||
6 | distributed to the municipalities collecting and disposing of | ||||||
7 | sewage in proportion to the percentage of territory located | ||||||
8 | within the boundaries of each affected municipality. | ||||||
9 | (c) The corporate authorities of any municipality required | ||||||
10 | to provide sewer service under this Section after the | ||||||
11 | dissolution of a sanitary district is hereby authorized to levy | ||||||
12 | and collect a tax for the purpose of maintaining, constructing | ||||||
13 | or replacing sewers, upon the taxable property within that | ||||||
14 | municipality, the aggregate amount of which for each year may | ||||||
15 | not exceed 0.25% of the value of such property as equalized or | ||||||
16 | assessed by the Department of Revenue and that tax shall be in | ||||||
17 | addition to any taxes that may otherwise be authorized to be | ||||||
18 | levied for the general corporate purposes of the municipality | ||||||
19 | as currently provided in Section 37 of this Act. Any | ||||||
20 | outstanding obligations of the dissolved sanitary district | ||||||
21 | shall be paid from the taxes levied and collected pursuant to | ||||||
22 | this subsection. | ||||||
23 | If any tax has been levied for sewer or water purposes | ||||||
24 | prior to the effective date of this amendatory Act of the 99th | ||||||
25 | General Assembly by a municipality who would also have the | ||||||
26 | power to levy such a tax under this subsection, that tax is |

2 | Section 99. Effective date. This Act takes effect upon | ||||||
3 | becoming law.
