1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Vehicle Code is amended by changing
5 Section 13-103 as follows:
6 (625 ILCS 5/13-103) (from Ch. 95 1/2, par. 13-103)
7 Sec. 13-103. Official testing stations - Fee - Permit -
8 Bond. Upon the the payment of a fee of $10 and the filing of an
9 application by the proprietor of any vehicle service station or
10 public or private garage upon forms furnished by the
11 Department, accompanied by proof of experience, training and
12 ability of the operator of the testing equipment, together with
13 proof of installation of approved testing equipment as defined
14 in Section 13-102 and the giving of a bond conditioned upon
15 faithful observance of this Section and of rules and
16 regulations issued by the Department in the amount of $1,000
17 with security approved by the Department, the Department shall
18 issue a permit to the proprietor of such vehicle service
19 station or garage to operate an Official Testing Station. Such
20 permit shall expire 12 months following its issuance, but may
21 be renewed annually by complying with the requirements set
22 forth in this Section and upon the payment of a renewal fee of
23 $10. Proprietors of official testing stations for which permits

1 have been issued prior to the effective date of this Act may
2 renew such permits for the renewal fee of $10 on the expiration
3 of each 12 months following issuance of such permits, by
4 complying with the requirements set forth in this Section.
5 However, any city, village or incorporated town shall upon
6 application to the Department and without payment of any fee or
7 filing of any bond, but upon proof of experience, training and
8 ability of the operator of the testing equipment, and proof of
9 the installation of approved testing equipment as defined in
10 Section 13-102, be issued a permit to operate such testing
11 station as an Official Testing Station under this Act. The
12 permit so issued shall at all times be displayed in a prominent
13 place in the vehicle service station, garage or municipal
14 testing station which is licensed as an Official Testing
15 Station under this Act. No person or vehicle service station,
16 garage or municipal testing station shall in any manner claim
17 or represent himself or itself to be an official testing
18 station unless a permit has been issued to him or it as
19 provided in this Section.
20 Any person or municipality who or which has received a
21 permit under this Section may test his or its own second
22 division vehicles and issue certificates of safety and conduct
23 emission inspections of his or its own second division vehicles
24 in accordance with the requirements of Section 13-109.1 with
25 respect to any such second division vehicles owned, operated or
26 controlled by him or it.

1 Each such permit issued by the Department shall state on
2 its face the location of the official testing station to be
3 operated under the permit and safety tests shall be made only
4 at such location. However, the Department may, upon
5 application, authorize a change in the location of the official
6 testing station and the removal of the testing equipment to the
7 new location. Upon approval of such application, the Department
8 shall issue an endorsement which the applicant shall affix to
9 his permit. Such endorsement constitutes authority for the
10 applicant to make such change in location and to remove his
11 testing equipment at the times and to the places stated in the
12 endorsement.
