Bill Title: Amends the Animal Welfare Act. Provides that a kennel operator that maintains dogs and cats for boarding that is not staffed at all times shall be equipped with at least one fire alarm system or fire sprinkler system in operating condition in every building of the kennel operator that is used for the housing of animals. Provides that an applicable federal, State, or local law, rule, or building code requiring the installation or maintenance of fire alarm monitoring systems in a manner different from, but providing a level of safety for occupants that is equal to or greater than that provided by the amendatory Act, shall be deemed to comply with the amendatory Act and the requirements of the more stringent law shall govern. Provides that the State Fire Marshal shall inspect, or shall direct a local fire marshal to inspect, a kennel operator that maintains dogs and cats for boarding when a resident makes a credible complaint alleging that the kennel operator is not in compliance with the amendatory Act. Provides that local fire inspectors shall determine whether a kennel operator is in compliance with the amendatory Act during the course of routine building and fire inspections of the kennel operator. Provides that local fire officials and the State Fire Marshal shall immediately notify the Department of Agriculture upon discovery that a kennel operator is not in compliance with the amendatory Act. Provides that the Department shall deny issuing a license under the Act to a kennel operator that is not in compliance with the amendatory Act. Provides that a kennel operator that is already licensed under the Act and found by the Department not to be in compliance with amendatory Act shall be liable for $500 for the first violation, $1,500 for the second violation, and $2,500 and the loss of the license for the third violation.

1 | AN ACT concerning regulation.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Animal Welfare Act is amended by adding | ||||||
5 | Section 18.2 as follows:
| ||||||
6 | (225 ILCS 605/18.2 new) | ||||||
7 | Sec. 18.2. Fire alarm system. | ||||||
8 | (a) In this Section: | ||||||
9 | "Fire alarm system" means a system that automatically | ||||||
10 | triggers notification to local emergency responders when | ||||||
11 | activated. | ||||||
12 | "Staffing plan" means a plan to staff a kennel operator | ||||||
13 | anytime dogs or cats are on the premises. At a minimum, a | ||||||
14 | staffing plan must include the kennel operator's hours of | ||||||
15 | operation, number of staff, names of staff, and the staff's | ||||||
16 | contact information. The Department may adopt rules adding | ||||||
17 | requirements to a staffing plan. | ||||||
18 | "Qualified fire inspector" means a local fire official or a | ||||||
19 | building inspector working for a unit of local government or | ||||||
20 | fire protection district who is qualified to inspect buildings | ||||||
21 | for fire safety or building code compliance. | ||||||
22 | (b) A kennel operator that maintains dogs or cats for | ||||||
23 | boarding and that is not staffed at all times dogs or cats are |

1 | on the premises shall be equipped with at least one fire alarm | ||||||
2 | system or fire sprinkler system in operating condition in every | ||||||
3 | building of the kennel operator that is used for the housing of | ||||||
4 | animals. The kennel operator shall certify in its license | ||||||
5 | application and annually certify in its license renewal that | ||||||
6 | either: (1) its facility has a fire alarm system or a fire | ||||||
7 | sprinkler system, and shall include with the application or | ||||||
8 | license renewal an attached description and picture of the make | ||||||
9 | and model of the system used; or (2) the kennel is staffed at | ||||||
10 | all times dogs or cats are on the premises, and shall include | ||||||
11 | with the application or license renewal an attached staffing | ||||||
12 | plan. The Department shall include this certification on each | ||||||
13 | application for license or license renewal. | ||||||
14 | (c) A qualified fire inspector may inspect a kennel | ||||||
15 | operator that maintains dogs and cats for boarding during the | ||||||
16 | course of performing routine inspections. If during a routine | ||||||
17 | inspection a qualified fire inspector determines that the | ||||||
18 | kennel operator does not have a fire alarm system or fire | ||||||
19 | sprinkler system the inspector may inform the Department. | ||||||
20 | (d) For the purposes of this Section, veterinary hospitals, | ||||||
21 | practices, or offices are not kennel operators.

22 | Section 99. Effective date. This Act takes effect January | ||||||
23 | 1, 2020.
