 Amends the University of Illinois Hospital Act, the Hospital Licensing Act, the Managed Care Reform and Patient Rights Act, the Medical Practice Act of 1987, and the Illinois Public Aid Code. Provides that, notwithstanding any other provision of law, hospitals and physicians organized or licensed under the Acts and health plans and managed care organizations must provide medical facts regarding COVID-19 and vaccines that can be used to protect against COVID-19 to all patients under the care of the hospital, physician, health plan, or managed care organization. Makes conforming changes in the Illinois Insurance Code. Effective immediately.

1 AN ACT concerning regulation.


2 Be it enacted by the People of the State of Illinois,

3represented in the General Assembly:



4 Section 5. The University of Illinois Hospital Act is 
5amended by adding Section 8e as follows:

6 (110 ILCS 330/8e new)
7 Sec. 8e. COVID-19 and vaccine information. Notwithstanding 
8any other provision of law, the University of Illinois 
9Hospital must provide medical facts regarding COVID-19 and 
10vaccines that can be used to protect against COVID-19 to all 
11patients under the University of Illinois Hospital's care.

12 Section 10. The Hospital Licensing Act is amended by 
13adding Section 6.30 as follows:

14 (210 ILCS 85/6.30 new)
15 Sec. 6.30. COVID-19 and vaccine information. 
16Notwithstanding any other provision of law, a hospital 
17licensed under this Act must provide medical facts regarding 
18COVID-19 and vaccines that can be used to protect against 
19COVID-19 to all patients under the hospital's care.

20 Section 15. The Illinois Insurance Code is amended by

1changing Section 155.36 as follows:



2 (215 ILCS 5/155.36)



3 Sec. 155.36. Managed Care Reform and Patient Rights Act. 
4Insurance
companies that transact the kinds of insurance 
5authorized under Class 1(b) or
Class 2(a) of Section 4 of this 
6Code shall comply
with Sections 15.1, 45, 45.1, 45.2, and 85, 
7subsection (d) of Section 30, and the definition of the term 
8"emergency medical
condition" in Section
10 of the Managed 
9Care Reform and Patient Rights Act.

11 Section 20. The Managed Care Reform and Patient Rights Act 
12is amended by adding Section 15.1 as follows:

13 (215 ILCS 134/15.1 new)
14 Sec. 15.1. COVID-19 and vaccine information. 
15Notwithstanding any other provision of law, a health care plan 
16must provide medical facts regarding COVID-19 and vaccines 
17that can be used to protect against COVID-19 to all patients 
18under the hospital's care.

19 Section 25. The Medical Practice Act of 1987 is amended by 
20adding Section 3.6 as follows:

1 Sec. 3.6. COVID-19 and vaccine information. 
2Notwithstanding any other provision of law, a physician 
3licensed under this Act must provide medical facts regarding 
4COVID-19 and vaccines that can be used to protect against 
5COVID-19 to all patients under the physician's care.

6 Section 30. The Illinois Public Aid Code is amended by 
7adding Section 5-30.18 as follows:

8 (305 ILCS 5/5-30.18 new)
9 Sec. 5-30.18. COVID-19 and vaccine information.
10 (a) Notwithstanding any other provision of law, an MCO 
11must provide medical facts regarding COVID-19 and vaccines 
12that can be used to protect against COVID-19 to all patients 
13under the MCO's care.
14 (b) As used in this Section, "MCO" has the same meaning as 
15provided in Section 30.1.


16 Section 99. Effective date. This Act takes effect upon 
17becoming law.
