Bill Title: Creates the Low-Carbon Distribution and Delivery Act. Designates residentially zoned areas in counties with a population of 3,000,000 or more as low-carbon delivery zones. Requires a last-mile delivery to a low-carbon delivery zone to be made using a low-carbon delivery method. Requires the Department of Transportation to establish a Low-Carbon Fleet Rebate Program. Provides that the Program shall offer a qualifying purchaser a grant up to 50% toward the purchase of an electric-assist cargo bicycle. Provides that the Program shall offer increased grant incentives of an additional 25% of the purchase amount for the purchase of an electric-assist cargo bicycle that will deliver goods within a low-carbon delivery area that is also designated as an equity investment eligible community. Limits a grant provided under the Program to a maximum award of 75% of the purchase price per electric-assist cargo bicycle. Provides that multiple bicycles may be included in each grant under Program. Allows the Department to limit the amount or number of grants awarded to each qualifying purchaser. Requires a fleet owner to be domiciled in the State. Requires an electric-assist cargo bicycle that acquired using grants from the Program to operate exclusively within the State. Limits the concurrent exercise of home-rule powers. Defines terms.

1 | AN ACT concerning transportation.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 1. Short title. This Act may be cited as the | |||||||||||||||||||
5 | Low-Carbon Delivery and Distribution Act.

6 | Section 5. Definitions. As used in the Act: | |||||||||||||||||||
7 | "Electric-assist cargo bicycle" means a bicycle with 2 or | |||||||||||||||||||
8 | 3 wheels, a saddle, fully operative pedals for human | |||||||||||||||||||
9 | propulsion, and an electric motor. | |||||||||||||||||||
10 | "Equity investment eligible communities" has the meaning | |||||||||||||||||||
11 | given to that term in the Energy Transition Act. | |||||||||||||||||||
12 | "Last-mile delivery" means the movement of goods from a | |||||||||||||||||||
13 | transportation hub to the final delivery destination. | |||||||||||||||||||
14 | "Last-mile delivery" does not include the delivery of | |||||||||||||||||||
15 | furniture, appliance, or other large item not suitable for | |||||||||||||||||||
16 | utilizing a low-carbon delivery method. | |||||||||||||||||||
17 | "Program" means the Low-Carbon Fleet Rebate Program. | |||||||||||||||||||
18 | "Qualifying purchaser" means the fleet or owner who will | |||||||||||||||||||
19 | operate or manage the vehicle for a minimum period that shall | |||||||||||||||||||
20 | be designated by the Department of Transportation. The | |||||||||||||||||||
21 | qualifying purchaser must be a newly formed business entity | |||||||||||||||||||
22 | that is not a subsidiary of a parent organization that has a | |||||||||||||||||||
23 | gross annual revenue of $20,000,000 or more.

1 | Section 10. Low-carbon delivery zone; last-mile | ||||||
2 | deliveries. In a county with a population of 3,000,000 or | ||||||
3 | more, any residentially zoned area shall be designated as a | ||||||
4 | low-carbon delivery zone for the purposes of this Act. | ||||||
5 | A last-mile delivery to a low-carbon delivery zone shall | ||||||
6 | be made using a low-carbon delivery method, including, but not | ||||||
7 | limited to, bicycles, electric-assist cargo bicycles, electric | ||||||
8 | vehicles, or mopeds.

9 | Section 15. Rebate and incentive program. | ||||||
10 | (a) The Department of Transportation shall establish a | ||||||
11 | Low-Carbon Fleet Rebate Program to provide a fleet owner in | ||||||
12 | the State grants to promote and implement the requirements of | ||||||
13 | this Act. The Program shall offer a qualifying purchaser a | ||||||
14 | grant up to 50% of the purchase price for the purchase of an | ||||||
15 | electric-assist cargo bicycle. | ||||||
16 | (b) The Program shall offer increased grant incentives of | ||||||
17 | an additional 25% of the purchase amount for the purchase of an | ||||||
18 | electric-assist cargo bicycle that will deliver goods within a | ||||||
19 | low-carbon delivery area that is also designated as an equity | ||||||
20 | investment eligible community. | ||||||
21 | (c) A grant provided under the Program is limited to a | ||||||
22 | maximum award of 75% of the purchase price per electric-assist | ||||||
23 | cargo bicycle. Multiple bicycles may be included in each grant | ||||||
24 | under Program, however, the Department shall have the |

2 | grants awarded to each qualifying purchaser. | ||||||
3 | (d) A fleet owner must be domiciled in this State. | ||||||
4 | (e) An electric-assist cargo bicycle acquired using grants | ||||||
5 | from the Program must operate exclusively within this State.

6 | Section 20. Rules. The Secretary of Transportation shall | ||||||
7 | adopt rules to implement this Act.
