SYNOPSIS AS INTRODUCED:
630 ILCS 5/70

Amends the Public-Private Partnerships for Transportation Act. Provides that each responsible public entity shall explore and identify whether unhoused individuals live near or at the site of a transportation project before a project begins. Provides that if individuals are identified, the responsible public entity shall contact and coordinate with the Department of Human Services to relocate the individuals until the project is completed.

1 AN ACT concerning transportation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Public-Private Partnerships for
5Transportation Act is amended by changing Section 70 as
6follows:
7 (630 ILCS 5/70)
8 Sec. 70. Additional powers of responsible public entities
9with respect to transportation projects.
10 (a) Each responsible public entity may exercise any powers
11provided under this Act in participation or cooperation with
12any governmental entity and enter into any contracts to
13facilitate that participation or cooperation without
14compliance with any other statute. Each responsible public
15entity shall cooperate with each other and with other
16governmental entities in carrying out transportation projects
17under this Act.
18 (b) Each responsible public entity may make and enter into
19all contracts and agreements necessary or incidental to the
20performance of the responsible public entity's duties and the
21execution of the responsible public entity's powers under this
22Act. Except as otherwise required by law, these contracts or
23agreements are not subject to any approvals other than the

1approval of the responsible public entity and may be for any
2term of years and contain any terms that are considered
3reasonable by the responsible public entity.
4 (c) Each responsible public entity may pay the costs
5incurred under a public-private agreement entered into under
6this Act from any funds available to the responsible public
7entity under this Act or any other statute.
8 (d) A responsible public entity or other State agency may
9not take any action that would impair a public-private
10agreement entered into under this Act.
11 (e) Each responsible public entity may enter into an
12agreement between and among the contractor, the responsible
13public entity, and the Illinois State Police concerning the
14provision of law enforcement assistance with respect to a
15transportation project that is the subject of a public-private
16agreement under this Act.
17 (f) Each responsible public entity is authorized to enter
18into arrangements with the Illinois State Police related to
19costs incurred in providing law enforcement assistance under
20this Act.
21 (g) Each responsible public entity shall explore and
22identify whether unhoused individuals live near or at the site
23of a transportation project before a project begins. If
24individuals are identified, the responsible public entity
25shall contact and coordinate with the Department of Human
26Services to relocate the individuals until the project is
