1 AN ACT concerning civil law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the Public
5Duty Rule Codification Act.
6 Section 5. Findings; purpose.
7 (a) The General Assembly finds:
8 (1) On January 22, 2016, the Illinois Supreme Court, in
9 Coleman v. East Joliet Fire Protection District, 2016 IL
10 117952, abolished the public duty rule.
11 (2) The public duty rule is an important doctrine that
12 is grounded in the principle that the duty of a local
13 governmental entity to preserve the well-being of the
14 community is owed to the public at large rather than to
15 specific members of the community.
16 (b) It is the purpose of this Act to codify the public duty
17rule.
18 Section 10. Public duty rule. A local governmental entity
19and its employees owe no duty of care to individual members of
20the general public to provide governmental services.
