SYNOPSIS AS INTRODUCED:
405 ILCS 5/3-611 from Ch. 91 1/2, par. 3-611

Amends the Mental Health and Developmental Disabilities Code concerning persons subject to involuntary admission to a mental health facility on an inpatient basis. Provides that upon completion of the second certificate by a psychiatrist stating that the respondent is subject to involuntary admission on an inpatient basis, the facility director shall provide a copy to the respondent. Effective immediately.

1 AN ACT concerning health.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Mental Health and Developmental
5Disabilities Code is amended by changing Section 3-611 as
6follows:
7 (405 ILCS 5/3-611) (from Ch. 91 1/2, par. 3-611)
8 Sec. 3-611. Within 24 hours, excluding Saturdays, Sundays
9and holidays, after the respondent's admission under this
10Article, the facility director of the facility shall file 2
11copies of the petition, the first certificate, and proof of
12service of the petition and statement of rights upon the
13respondent with the court in the county in which the facility
14is located. Upon completion of the second certificate, the
15facility director shall promptly file it with the court and
16provide a copy to the respondent. The facility director shall
17make copies of the certificates available to the attorneys for
18the parties upon request. Upon the filing of the petition and
19first certificate, the court shall set a hearing to be held
20within 5 days, excluding Saturdays, Sundays and holidays, after
21receipt of the petition. The court shall direct that notice of
22the time and place of the hearing be served upon the
23respondent, his responsible relatives, and the persons

1entitled to receive a copy of the petition pursuant to Section
23-609.

4 Section 99. Effective date. This Act takes effect upon
