Amends the Counties Code and Illinois Municipal Code. Provides deputies employed by a county and police officers employed by a municipality shall be provided mental health counseling services by the respective county or municipality. Limits home rule powers. Amends the State Mandates Act to require implementation without reimbursement.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Counties Code is amended by adding Sections
53-6041 and 11-1-14 as follows:
6 (55 ILCS 5/3-6041 new)
7 Sec. 3-6041. Mental health services. The sheriff of each
8county shall provide mental health services to all deputies
9employed by the county. A home rule unit may not regulate
10mental health services in a manner inconsistent with this
11Section. This Section is a limitation under subsection (i) of
12Section 6 of Article VII of the Illinois Constitution on the
13concurrent exercise by home rule units of powers and functions
14exercised by the State.

16 Sec. 11-1-14. Mental health services. The corporate
17authorities of each municipality shall provide mental health
18services to all police officers employed by the municipality. A
19home rule unit may not regulate mental health services in a
20manner inconsistent with this Section. This Section is a
21limitation under subsection (i) of Section 6 of Article VII of
22the Illinois Constitution on the concurrent exercise by home

2 Section 90. The State Mandates Act is amended by adding
3Section 8.40 as follows:
4 (30 ILCS 805/8.40 new)
5 Sec. 8.40. Exempt mandate. Notwithstanding Sections 6 and 8
6of this Act, no reimbursement by the State is required for the
7implementation of any mandate created by this amendatory Act of
8the 99th General Assembly.
