Bill Title: Reinserts the provisions of the engrossed bill with changes. In provisions creating the Property Tax Payment Plan Task Force, adds one member appointed by the Minority Leader of the Senate and one member appointed by the Minority Leader of the House of Representatives. Makes technical corrections. Effective immediately.

1 AN ACT concerning revenue.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Housing Development Act is amended
5by adding Section 35 as follows:
6 (20 ILCS 3805/35 new)
7 Sec. 35. Property Tax Payment Plan Task Force.
8 (a) In counties with 3,000,000 or more inhabitants, the
9annual tax sale has a disproportionately negative impact on
10minority communities. The loss of owner-occupied homes as the
11result of the tax sale results in a loss of home equity for
12impacted households and negatively impacts their ability to
13build generational wealth. The creation of a well-designed
14payment plan program for owner-occupants to repay delinquent
15property taxes has the potential to help homeowners who cannot
16afford their property taxes avoid the tax sale and potential
17loss of their home, while also ensuring that property taxes
18are collected for the benefit of local taxing districts,
19contributing to a more equitable and effective property tax
20system.
21 (b) The Property Tax Payment Plan Task Force is hereby
22created. The Task Force shall consist of the following
23members:

1 (1) one co-chairperson appointed by the President of
2 the Senate;
3 (2) one co-chairperson appointed by the Speaker of the
4 House of Representatives;
5 (3) one member appointed by the executive director of
6 the Illinois Housing Development Authority;
7 (4) one member representing the Cook County
8 Treasurer's Office, appointed by the Governor;
9 (5) one member representing the Cook County Clerk's
10 office, appointed by the Governor;
11 (6) one member representing the Cook County
12 President's Office, appointed by the Governor;
13 (7) up to 2 members, appointed by the Governor,
14 representing nonprofit affordable housing organizations in
15 counties with 3,000,000 or more inhabitants, housing
16 counseling organizations in counties with 3,000,000 or
17 more inhabitants, or homeownership organizations in
18 counties with 3,000,000 or more inhabitants;
19 (8) up to 2 members, appointed by the Governor,
20 representing community, neighborhood, or resident
21 associations in counties with 3,000,000 or more
22 inhabitants;
23 (9) up to 2 members, appointed by the Governor,
24 representing public interest organizations from counties
25 with 3,000,000 or more inhabitants or civic organizations
26 from counties with 3,000,000 or more inhabitants;

1 (10) up to 3 members, appointed by the Governor,
2 representing local municipalities with properties that are
3 the most highly represented in the annual tax sale in
4 counties with 3,000,000 or more inhabitants; and
5 (11) up to 3 members, appointed by the Governor,
6 representing taxing districts, other than municipalities,
7 with properties that are the most highly represented in
8 the annual tax sale in counties with 3,000,000 or more
9 inhabitants.
10 Members of the Task Force shall be appointed no later than
1130 days after the effective date of this amendatory Act of the
12103rd General Assembly. If any members are not appointed
13within that 30-day period, the appointing authority shall be
14deemed to have waived the right to make that appointment.
15Vacancies in the Task Force, other than a vacancy occurring
16because of a waiver by the appointing authority under this
17subsection, shall be filled by the original appointing
18authority.
19 (c) Members of the Task Force shall serve without
20compensation. The Illinois Housing Development Authority shall
21provide administrative support to the Task Force as needed.
22 (d) The members of the Task Force are exempt from any
23training, disclosure, or filing requirements under the State
24Officials and Employees Ethics Act, the Illinois Governmental
25Ethics Act, or any other applicable State law or rule imposing
26such requirements.

1 (e) Once all of the members have been appointed, the Task
2Force shall meet not less than 4 times to carry out the duties
3prescribed in this Section. Members of the Task Force may
4attend those meetings virtually.
5 (f) The Task Force shall study and make recommendations
6for the implementation of one or more payment plan options in
7counties with 3,000,000 or more inhabitants to prevent
8eligible tax-delinquent owner-occupied properties in those
9counties from being sold at the annual tax sale. The Task Force
10shall take into consideration the impact of the payment plan
11option on homeowners, taxpayers, local agencies responsible
12for the collection of property taxes, and local taxing
13districts. These recommendations may be used to recommend
14legislation in a future General Assembly.
15 (g) A report detailing the Task Force's findings,
16conclusions, and recommendations shall be submitted to the
17General Assembly no later than November 15, 2023. The Task
18Force is dissolved upon submission of the report.
19 (h) This Section is repealed on January 1, 2025.
20 Section 99. Effective date. This Act takes effect upon
21becoming law.
