|
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Conveyances Act is amended by changing |
| 5 | | Section 4 as follows:
|
| 6 | | (765 ILCS 5/4) (from Ch. 30, par. 4)
|
| 7 | | Sec. 4.
Any person claiming right or title to lands, |
| 8 | | tenements or
hereditaments, although he, she or they may be out |
| 9 | | of possession, and
and
notwithstanding there may be an adverse |
| 10 | | possession thereof, may sell,
convey and transfer his or her |
| 11 | | interest in and to the same, in as full and
complete a manner |
| 12 | | as if he or she were in the actual possession of the
lands and |
| 13 | | premises intended to be conveyed; and the grantee or grantees
|
| 14 | | shall have the same right of action for the recovery thereof, |
| 15 | | and shall in
all respects derive the same benefit and advantage |
| 16 | | therefrom, as if the
grantor or grantors had been in the actual |
| 17 | | possession at the time of
executing the conveyance. |
