Bill Title: Amends the Criminal Code of 2012. Provides that a person commits residential burglary when he or she knowingly and without authority enters on the property of another, or any part thereof, with the intent to commit therein a theft of a motor vehicle. Effective immediately.

1 | AN ACT concerning criminal law.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Criminal Code of 2012 is amended by | |||||||||||||||||||
5 | changing Section 19-3 as follows:

6 | (720 ILCS 5/19-3) (from Ch. 38, par. 19-3) | |||||||||||||||||||
7 | Sec. 19-3. Residential burglary. | |||||||||||||||||||
8 | (a) A person commits
residential burglary when he or she | |||||||||||||||||||
9 | knowingly and without authority enters or knowingly
and | |||||||||||||||||||
10 | without authority remains within the
dwelling place of | |||||||||||||||||||
11 | another, or any part thereof, with the intent to commit
| |||||||||||||||||||
12 | therein a felony or theft. This offense includes the offense | |||||||||||||||||||
13 | of
burglary as defined in Section 19-1. | |||||||||||||||||||
14 | (a-5) A person commits
residential burglary when he or she | |||||||||||||||||||
15 | falsely represents himself or herself, including but not | |||||||||||||||||||
16 | limited to falsely representing himself or herself to be a | |||||||||||||||||||
17 | representative of any unit of government or a construction, | |||||||||||||||||||
18 | telecommunications, or utility company, for the purpose of | |||||||||||||||||||
19 | gaining entry to the dwelling place of another, with the | |||||||||||||||||||
20 | intent to commit
therein a felony or theft or to facilitate the | |||||||||||||||||||
21 | commission therein of a felony or theft by another. | |||||||||||||||||||
22 | (a-10) A person commits residential burglary when he or | |||||||||||||||||||
23 | she knowingly and without authority enters on the property of |

2 | therein a theft of a motor vehicle. | ||||||
3 | (b) Sentence. Residential burglary is a Class 1 felony. | ||||||
