AMENDMENT TO SENATE BILL 1893
2 AMENDMENT NO. ______. Amend Senate Bill 1893 by replacing
3everything after the enacting clause with the following:
4 "Section 5. The Illinois Public Aid Code is amended by
5changing Section 4-23 as follows:
6 (305 ILCS 5/4-23)
7 Sec. 4-23. Civil rights impact statement.
8 (a) The Department of Human Services must submit to the
9Governor and the General Assembly on January 1 of each
10even-numbered year a written report that details the disparate
11impact of various provisions of the TANF program on people of
12different racial or ethnic groups who identify themselves in an
13application for benefits as any of the following:
14 (1) American Indian or Alaska Native (a person having
15 origins in any of the original peoples of North and South
16 America, including Central America, and who maintains

1 tribal affiliation or community attachment).
2 (2) Asian (a person having origins in any of the
3 original peoples of the Far East, Southeast Asia, or the
4 Indian subcontinent, including, but not limited to,
5 Cambodia, China, India, Japan, Korea, Malaysia, Pakistan,
6 the Philippine Islands, Thailand, and Vietnam).
7 (3) Black or African American (a person having origins
8 in any of the black racial groups of Africa). Terms such as
9 "Haitian" or "Negro" can be used in addition to "Black or
10 African American".
11 (4) Hispanic or Latino (a person of Cuban, Mexican,
12 Puerto Rican, South or Central American, or other Spanish
13 culture or origin, regardless of race).
14 (5) Native Hawaiian or Other Pacific Islander (a person
15 having origins in any of the original peoples of Hawaii,
16 Guam, Samoa, or other Pacific Islands).
17 (6) White (a person having origins in any of the
18 original peoples of Europe, the Middle East, or North
19 Africa).
20 (b) The report must at least compare the number of persons
21in each group:
22 (1) who are receiving TANF assistance;
23 (2) whose 60-month lifetime limit on receiving
24 assistance has expired;
25 (3) who have left TANF due to earned income;
26 (4) who have left TANF due to non-compliance with

1 program rules;
2 (5) whose TANF grants have been reduced by sanctions
3 for non-compliance with program rules;
4 (6) who have returned to TANF 6 months after leaving
5 due to earned income;
6 (7) who have returned to TANF 12 months after leaving
7 due to earned income;
8 (8) who have one or more children excluded from
9 receiving TANF cash assistance due to the child exclusion
10 rule;
11 (9) who have been granted an exemption from work
12 requirements; and
13 (10) who are participating in post-secondary education
14 activities; and .
15 (11) who have lost or have had TANF benefits reduced
16 due to non-compliance with education requirements.

18 Section 99. Effective date. This Act takes effect upon
19becoming law.".
