SYNOPSIS AS INTRODUCED:
225 ILCS 312/10

Amends the Elevator Safety and Regulation Act. Provides that the Act applies to any State-owned buildings within a municipality with a population over 500,000. Provides that the amendatory Act is a clarification of existing law and shall be retroactive to June 1, 2003.

1 AN ACT concerning regulation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Elevator Safety and Regulation Act is
5amended by changing Section 10 as follows:
6 (225 ILCS 312/10)
7 (Section scheduled to be repealed on January 1, 2023)
8 Sec. 10. Applicability.
9 (a) This Act covers the construction, operation,
10inspection, testing, maintenance, alteration, and repair of
11the following equipment, its associated parts, and its
12hoistways (except as modified by subsection (c) of this
13Section):
14 (1) Hoisting and lowering mechanisms equipped with a
15 car or platform, which move between 2 or more landings.
16 This equipment includes, but is not limited to, the
17 following (also see ASME A17.1, ASME A17.3, and ASME
18 A18.1):
19 (A) Elevators.
20 (B) Platform lifts and stairway chair lifts.
21 (2) Power driven stairways and walkways for carrying
22 persons between landings. This equipment includes, but is
23 not limited to, the following (also see ASME A17.1 and

1 ASME A17.3):
2 (A) Escalators.
3 (B) Moving walks.
4 (3) Hoisting and lowering mechanisms equipped with a
5 car, which serves 2 or more landings and is restricted to
6 the carrying of material by its limited size or limited
7 access to the car. This equipment includes, but is not
8 limited to, the following (also see ASME A17.1 and ASME
9 A17.3):
10 (A) Dumbwaiters.
11 (B) Material lifts and dumbwaiters with automatic
12 transfer devices.
13 (b) This Act covers the construction, operation,
14inspection, maintenance, alteration, and repair of automatic
15guided transit vehicles on guideways with an exclusive
16right-of-way. This equipment includes, but is not limited to,
17automated people movers (also see ASCE 21).
18 (c) This Act does not apply to the following equipment:
19 (1) Material hoists within the scope of ANSI A10.5.
20 (2) Manlifts within the scope of ASME A90.1.
21 (3) Mobile scaffolds, towers, and platforms within the
22 scope of ANSI A92.
23 (4) Powered platforms and equipment for exterior and
24 interior maintenance within the scope of ANSI 120.1.
25 (5) Conveyors and related equipment within the scope
26 of ASME B20.1.

1 (6) Cranes, derricks, hoists, hooks, jacks, and slings
2 within the scope of ASME B30.
3 (7) Industrial trucks within the scope of ASME B56.
4 (8) Portable equipment, except for portable escalators
5 that are covered by ANSI A17.1.
6 (9) Tiering or piling machines used to move materials
7 to and from storage located and operating entirely within
8 one story.
9 (10) Equipment for feeding or positioning materials at
10 machine tools, printing presses, etc.
11 (11) Skip or furnace hoists.
12 (12) Wharf ramps.
13 (13) Railroad car lifts or dumpers.
14 (14) Line jacks, false cars, shafters, moving
15 platforms, and similar equipment used for installing an
16 elevator by a contractor licensed in this State.
17 (15) (Blank).
18 (16) Conveyances located in a private residence not
19 accessible to the public.
20 (17) Special purpose personnel elevators within the
21 scope of ASME A17.1 and used only by authorized personnel.
22 (18) Personnel hoists within the scope of ANSI A10.4.
23 (d) This Act does not apply to a municipality with a
24population over 500,000, except for any State-owned buildings
25within such municipality. This amendatory Act of the 102nd
26General Assembly is a clarification of existing law and shall
