Bill Title: Amends the Counties Code. Provides that the court may, upon the motion of any interested party for good cause shown, temporarily appoint a coroner who has a mutual aid agreement with the coroner having jurisdiction to perform the duties of the coroner having jurisdiction. Requires the court to appoint such a coroner within 24 hours of the filing of the motion to appoint. Sets forth the appointed coroner's authorized duties and scope of jurisdiction. Effective immediately.

1 | AN ACT concerning local government, which may be known as | |||||||||||||||||||
2 | Leslie's Law.

3 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
4 | represented in the General Assembly:

5 | Section 5. The Counties Code is amended by changing Section | |||||||||||||||||||
6 | 3-3009 as follows:

8 | Sec. 3-3009.
Deputy coroner's, sheriff's or police | |||||||||||||||||||
9 | officer's performance
of coroner's

10 | (a) If there is no coroner, or it shall appear in like | |||||||||||||||||||
11 | manner that he
is also a party to or interested in the suit, or | |||||||||||||||||||
12 | of kin, or partial to or
prejudiced against either party, | |||||||||||||||||||
13 | process may in like manner issue to the
deputy coroner if | |||||||||||||||||||
14 | designated by the coroner to fill the vacancy, or, if no
| |||||||||||||||||||
15 | designation is
made, to any
sheriff, sheriff's deputy or police | |||||||||||||||||||
16 | officer, in the county, who shall
perform like duties as | |||||||||||||||||||
17 | required of the coroner.
The designation shall be in writing | |||||||||||||||||||
18 | and filed with the county clerk. | |||||||||||||||||||
19 | (b) The court may, upon the motion of any interested party | |||||||||||||||||||
20 | for good cause shown, temporarily appoint a coroner who has a | |||||||||||||||||||
21 | mutual aid agreement with the coroner having jurisdiction to | |||||||||||||||||||
22 | perform the duties of the coroner having jurisdiction. The | |||||||||||||||||||
23 | court shall make this appointment within 24 hours of the filing |

1 | of the motion under this subsection. The coroner appointed | ||||||
2 | under the provisions of this subsection shall have the same | ||||||
3 | power and authority within the county in relation to such | ||||||
4 | matters as the coroner having jurisdiction would have had if | ||||||
5 | attending the same. All expenses incurred for the investigation | ||||||
6 | of said matters shall be paid by the county where the death | ||||||
7 | occurred. The temporary appointment shall have jurisdiction | ||||||
8 | only over the matters provided in the court's order and shall | ||||||
9 | terminate upon completion of the final certification of death.
