1 | AN ACT concerning criminal law.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Criminal Code of 1961 is amended by changing | |||||||||||||||||||
5 | Section 19-2 as follows:

7 | Sec. 19-2. Possession of burglary tools.

8 | (a) A person commits
the
the offense of possession of | |||||||||||||||||||
9 | burglary tools when he
possesses any key, tool, instrument, | |||||||||||||||||||
10 | device, or any explosive, suitable for
use in breaking into a | |||||||||||||||||||
11 | building, housetrailer, watercraft, aircraft, motor
vehicle as | |||||||||||||||||||
12 | defined in The Illinois Vehicle Code, railroad car, or any
| |||||||||||||||||||
13 | depository designed for the safekeeping of property, or any | |||||||||||||||||||
14 | part thereof,
with intent to enter any such place and with | |||||||||||||||||||
15 | intent to commit therein a
felony or theft. The trier of fact | |||||||||||||||||||
16 | may infer from the possession of a key designed for lock | |||||||||||||||||||
17 | bumping an intent to commit a felony or theft; however, this | |||||||||||||||||||
18 | inference does not apply to any peace officer or other employee | |||||||||||||||||||
19 | of a law enforcement agency, or to any person or agency | |||||||||||||||||||
20 | licensed under the Private Detective, Private Alarm, Private | |||||||||||||||||||
21 | Security, Fingerprint Vendor, and Locksmith Act of 2004. For | |||||||||||||||||||
22 | the purposes of this Section, "lock bumping" means a lock | |||||||||||||||||||
23 | picking technique for opening a pin tumbler lock using a |

2 | (b) Sentence.
| ||||||
3 | Possession of burglary tools in violation of this Section | ||||||
4 | is a Class 4
felony.
