1 AN ACT concerning criminal law.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Criminal Code of 1961 is amended by changing
5Section 19-2 as follows:
6 (720 ILCS 5/19-2) (from Ch. 38, par. 19-2)
7 Sec. 19-2. Possession of burglary tools.
8 (a) A person commits the the offense of possession of
9burglary tools when he possesses any key, tool, instrument,
10device, or any explosive, suitable for use in breaking into a
11building, housetrailer, watercraft, aircraft, motor vehicle as
12defined in The Illinois Vehicle Code, railroad car, or any
13depository designed for the safekeeping of property, or any
14part thereof, with intent to enter any such place and with
15intent to commit therein a felony or theft. The trier of fact
16may infer from the possession of a key designed for lock
17bumping an intent to commit a felony or theft; however, this
18inference does not apply to any peace officer or other employee
19of a law enforcement agency, or to any person or agency
20licensed under the Private Detective, Private Alarm, Private
21Security, Fingerprint Vendor, and Locksmith Act of 2004. For
22the purposes of this Section, "lock bumping" means a lock
23picking technique for opening a pin tumbler lock using a

1specially-crafted bumpkey.
2 (b) Sentence.
3 Possession of burglary tools in violation of this Section
4is a Class 4 felony.
