A BILL FOR AN ACT to amend the Indiana Code concerning
education.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 20-51-4-12 IS ADDED TO THE INDIANA CODE
AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE
UPON PASSAGE]: Sec. 12. (a) State tuition support distributions
to school corporations and charter schools may not be reduced to
pay for choice scholarships distributed under this chapter.
(b) A determination under IC 4-13-2-18 or another law that the
amount available for choice scholarships under this chapter for the
remainder of the term of an appropriation or for any allotment
period will be less than the amount estimated or allotted therefore
may not be the basis for reducing state tuition support
distributions to school corporations and charter schools.
(c) The actions prohibited by this section include any of the
following that has the direct or indirect effect of making an amount
available for choice scholarships:
(1) Payment of or encumbering an amount of a choice
scholarship from a distribution for tuition support
appropriation.
(2) Transfer of, assignment of, or reassignment of an amount
from a distribution for tuition support appropriation to
another purpose.
(3) Reduction of the maximum state distribution for a
calendar year under IC 20-43-2-2, IC 20-43-2-3, or another
law.
(4) Withholding allotment of amounts that otherwise are
available for state tuition support distributions to school
corporations and charter schools.
