Synopsis: Year to year tenancy on land used for agriculture. Provides
that a year to year tenancy on real property used for agriculture
terminates on March 1 if the landlord or tenant gives written notice
before the preceding October 1.

A BILL FOR AN ACT to amend the Indiana Code concerning
property.
Be it enacted by the General Assembly of the State of Indiana:

SECTION 1. IC 32-31-1-3 IS AMENDED TO READ AS
FOLLOWS [EFFECTIVE JULY 1, 2010]: Sec. 3.
(a) Except as
provided in subsection (b), a tenancy from year to year may be
determined by a notice given to the tenant not less than three (3)
months before the expiration of the year.
(b) When real property used for the production of agricultural
crops is subject to a tenancy from year to year, the tenancy from
year to year terminates on March 1 if the landlord or tenant
receives written notice of the termination of the tenancy before
October 1 of the preceding year, unless otherwise agreed to in a
written contract between the landlord and tenant.
