A bill to amend 2019 PA 39, entitled

"Administration of opioid antagonists act,"

by amending sections 103 and 105 (MCL 15.673 and 15.675).

the people of the state of michigan enact:

Sec. 103. (1) An Except as otherwise provided in subsection (2), an agency may purchase obtain and possess an opioid antagonist for purposes of this act and distribute that opioid antagonist to an employee or agent who has been trained in the administration of that opioid antagonist for purposes of this act.

(2) Beginning 6 months after the effective date of the amendatory act that added this subsection or beginning the first school year that begins after the effective date of the amendatory act that added this subsection, whichever is later, an agency that is a school district shall obtain an opioid antagonist for purposes of this act and distribute that opioid antagonist to each school within the school district that offers any of grades 6 to 12, and to an employee or agent of the schools described in this subsection.

Sec. 105. (1) An employee or agent may possess an opioid antagonist distributed to that employee or agent under section 103 and may administer that opioid antagonist to an individual if both of the following apply:

(a) The employee or agent has been trained in the proper administration of that opioid antagonist.

(b) The employee or agent has reason to believe that the individual is experiencing an opioid-related overdose.

(2) An agency described in section 103(2) shall ensure that an employee or agent of that agency is trained in the manner described in this section.

Enacting section 1. This amendatory act does not take effect unless all of the following bills of the 102nd Legislature are enacted into law:

(a) Senate Bill No.____ or House Bill No. 4737 (request no. 02913'23 *).

(b) Senate Bill No.____ or House Bill No. 4736 (request no. 02914'23 *).

(c) Senate Bill No.____ or House Bill No. 4734 (request no. 03377'23).
