HOUSE BILL No. 5876

April 25, 2018, Introduced by Rep. LaFave and referred to the Committee on Health Policy.

A bill to amend 1976 PA 220, entitled

"Persons with disabilities civil rights act,"

(MCL 37.1101 to 37.1607) by adding section 102a.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

Sec. 102a. (1) The civil rights commission shall adopt and

post on the department of civil rights' website a standardized

design that is a variation of the current international symbol of

accessibility. The design must depict a dynamic character leaning

forward in a wheelchair with a sense of movement. The design must

be simple, avoid any secondary meaning, and facilitate

accessibility to a degree equivalent to the existing universal

symbol of access. It must not include any written words, such as

"handicapped", or any other designation or information.

     (2) Beginning 1 year after the effective date of the

amendatory act that added this section, each new placement or

replacement of an international symbol of accessibility sign

required by law, ordinance, or administrative rule of this state or

a local unit of government of this state must use the design

adopted under this section. The civil rights commission and the

department of civil rights shall encourage use of the dynamic

design for each voluntary placement or replacement of an

international symbol of accessibility sign.

     (3) The civil rights commission and the department of civil

rights shall take necessary steps to have the word "handicapped"

removed from any signs or other means of communication of this

state or any local unit of government of this state.

Enacting section 1. This amendatory act takes effect 90 days

after the date it is enacted into law.

Enacting section 2. This amendatory act does not take effect

unless Senate Bill No.____ or House Bill No. 5877 (request no.

01958'17) of the 99th Legislature is enacted into law.
