A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 61506d.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 61506d. (1) The department shall require as a condition
of a permit issued under this part or any other authorization to
use an oil or gas well for hydraulic fracturing that the permit
holder is prohibited from injecting any water or other substance
used in the hydraulic fracturing process into an aquifer.
(2) As used in this section:
(a) "Aquifer" means any water-bearing bed or stratum of earth
or rock capable of yielding groundwater to a water well in
sufficient quantities that can be withdrawn.
(b) "Hydraulic fracturing" means injecting substances
including, but not limited to, water, fluids, chemicals, foam, and
proppants into a well or a rock formation under high pressure to
create fractures, for purposes of exploration, drilling,
completion, or production of oil, natural gas, or hydrocarbons or
to enhance the production of oil, natural gas, or hydrocarbons.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
