A bill to amend 2016 PA 235, entitled
"Public threat alert system act,"
by amending sections 2 and 3 (MCL 28.672 and 28.673).
the people of the state of michigan enact:
Sec. 2. As used
in this act, "public threat" means a clear, present, persistent,
ongoing, and random threat to public safety
that is likely to lead to an immediate or nearly immediate loss of life or
property. A public threat includes, but is not limited to, an any
of the following:
(a)
An act of terrorism. , an
(b)
An unresolved mass shooting. , or an
(c)
An unresolved mass shooting spree.
(d)
A natural disaster including, but not limited to, a severe storm or flood.
(e)
An industrial explosion.
(f)
A train derailment.
(g)
An announcement of an endangered missing individual.
Sec. 3. (1) The
department of state police shall establish and maintain the public threat alert
system plan.
(2) The public threat alert system plan shall must
be designed to rapidly disseminate useful information in a
predetermined manner to radio and television stations within this state and to
wireless devices through the existing wireless emergency alert system operated
under federal law.
(3) The Subject to subsection (4), the public threat alert
system plan shall must
be activated only in accordance with the policies established by
the department of state police.
(4) The public threat alert system plan must not be activated to transmit an announcement of a new law or executive order, including transmitting to wireless devices through the existing wireless emergency alert system operated under federal law, unless it is necessary to transmit the announcement of the new law or executive order using the public threat alert system plan to respond to an immediate or nearly immediate loss of life or property.
