1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
1.5 Section 1. Minnesota Statutes 2010, section 115A.904, is amended to read:
1.6115A.904 LAND DISPOSAL PROHIBITED.
1.7The disposal of waste tires in the land is prohibited after July 1, 1985
, except for
1.8beneficial uses of tire-derived products designated by the commissioner. This does not
1.9prohibit the storage of unprocessed waste tires at a collection or processing facility.
1.10 Sec. 2. Minnesota Statutes 2010, section 115A.912, subdivision 4, is amended to read:
1.11 Subd. 4.
Waste tire materials; prohibition. Materials derived from waste tires may
1.12not be used as lightweight fill in
the construction of public roads
and private development
1.13projects in the state
unless, if the construction plan is prepared by a professional engineer
1.14experienced in the geotechnical field and licensed in the state of Minnesota. The plan
1.15shall include, but not be limited to, the location, duration, and length of the project, the
1.16depth of fill, the depth of cover, the size of waste tire pieces, the plan for encapsulating
1.17the waste tire pieces, and the fire protection plan. All engineering specifications must be
1.18consistent
with ASTM Standard Practice for Use of Scrap Tires in Civil Engineering
1.19Applications (D6270-08), section 6, Construction Practices, or with the current lightweight
1.20tire fill engineering practices as developed for roadways by the Minnesota Department
1.21of Transportation.
