AN ACT
To amend chapter 226, RSMo, by adding thereto one new section relating to roadside vegetation.
Be it enacted by the General Assembly of the state of Missouri, as follows:
Section A. Chapter 226, RSMo, is amended by adding thereto one new section, to be known as section 226.1120, to read as follows:
226.1120. 1. The provisions of this section shall be known as the "Show-Me Harvest Initiative".
2. Notwithstanding any law, the state department of transportation shall allow persons or entities to submit bids to mow grass or vegetation along state roadways. Persons or entities awarded contracts under this section shall use their own equipment for mowing and, in addition to receiving monetary compensation for their work, shall be awarded hay rights in the section they mow.
3. Notwithstanding any other law, the state department of transportation may enter into contracts with persons or entities to plant and harvest switchgrass, or other grasses or produce approved by the department, on the right-of-way of any state roadway. Any such contract shall be for a duration of at least five years.
4. The department of transportation may promulgate rules necessary to carry out the purpose of this section. Any rule or portion of a rule, as that term is defined in section 536.010, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536 and, if applicable, section 536.028. This section and chapter 536 are nonseverable and if any of the powers vested with the general assembly pursuant to chapter 536 to review, to delay the effective date, or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2012, shall be invalid and void.
