AN ACT

To repeal section 33.080, RSMo, and to enact in lieu thereof one new section relating to certain state funds, with penalty provisions.




Be it enacted by the General Assembly of the state of Missouri, as follows:


            Section A. Section 33.080, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 33.080, to read as follows:

            33.080. 1. All fees, funds and moneys from whatsoever source received by any department, board, bureau, commission, institution, official or agency of the state government by virtue of any law or rule or regulation made in accordance with any law, excluding all funds received and disbursed by the state on behalf of counties and cities, towns and villages shall, by the official authorized to receive same, and at stated intervals of not more than thirty days, be placed in the state treasury to the credit of the particular purpose or fund for which collected, and shall be subject to appropriation by the general assembly for the particular purpose or fund for which collected during the biennium in which collected and appropriated. The unexpended balance remaining in all such funds (except such unexpended balance as may remain in any fund authorized, collected and expended by virtue of the provisions of the constitution of this state) shall at the end of the biennium and after all warrants on same have been discharged and the appropriation thereof has lapsed, be transferred and placed to the credit of the [ordinary] general revenue fund of the state by the state treasurer. Any official or any person who shall willfully fail to comply with any of the provisions of this section, and any person who shall willfully violate any provision hereof, shall be deemed guilty of a misdemeanor; provided, that all such money received by the curators of the University of Missouri except those funds required by law or by instrument granting the same to be paid into the seminary fund of the state, is excepted herefrom, and in the case of other state educational institutions there is excepted herefrom, gifts or trust funds from whatever source; appropriations; gifts or grants from the federal government, private organizations and individuals; funds for or from student activities; farm or housing activities; and other funds from which the whole or some part thereof may be liable to be repaid to the person contributing the same; and hospital fees. All of the above excepted funds shall be reported in detail quarterly to the governor and biennially to the general assembly.

            2. Notwithstanding any provision of law to the contrary concerning the funds listed in subdivisions (1) to (23) of this subsection, not more than the amount specified for each fund listed in subdivisions (1) to (23) of this subsection shall be transferred and placed to the credit of the general revenue fund of the state by the state treasurer before June 30, 2011. The funds subject to the provisions of this subsection and the maximum amount of the transfer are as follows:

            (1) Health initiatives fund established under section 191.831, one million dollars;

            (2) Business extension service team fund established under section 620.1023, eight hundred eighteen thousand two hundred ninety dollars;

            (3) Deaf relay service and equipment distribution program fund established under section 209.258, two million dollars;

            (4) Endowed care cemetery audit fund established under section 193.265, eighty-six thousand dollars;

            (5) Insurance dedicated fund established under section 374.150, four million three hundred three thousand dollars;

            (6) Spinal cord injury fund established under section 304.027, four million dollars;

            (7) Services to victims fund established under section 595.100, four million dollars;

            (8) State board of accountancy fund established under section 326.319, six hundred thousand dollars;

            (9) Board of registration for the healing arts fund established under section 334.050, nine hundred fifty thousand dollars;

            (10) State board of nursing fund established under section 335.036, three million six hundred thousand dollars;

            (11) Board of pharmacy fund established under section 338.070, fifty thousand dollars;

            (12) Petroleum inspection fund established under section 414.082, three hundred thousand dollars;

            (13) Committee of professional counselors fund established under section 337.507, one hundred fifty thousand dollars;

            (14) State board for architects, professional engineers, land surveyors and landscape architects fund established under section 327.081, one million six hundred forty thousand dollars;

            (15) Athletic fund established under section 317.006, forty thousand dollars;

            (16) Economic development advancement fund established under section 620.1900, five hundred thousand dollars;

            (17) Board of cosmetology and barber examiners fund established under section 329.028, four hundred seventy-five thousand dollars;

            (18) Missouri wine and grape fund established under section 311.554, one hundred thousand dollars;

            (19) Marital and family therapists' fund established under section 337.712, nineteen thousand dollars;

            (20) Respiratory care practitioners fund established under section 334.850, four thousand dollars;

            (21) Missouri board of occupational therapy fund established under section 324.074, forty-four thousand dollars;

            (22) Dietitian fund established under section 324.212, sixty-six thousand dollars;

            (23) Aviation trust fund established under section 155.090, two million three hundred fourteen thousand three hundred sixty-three dollars.
