AN ACT TO PROVIDE THAT ANY MEMBER OF A BOARD OR COMMISSION THAT WAS CREATED BY STATE LAW SHALL ONLY BE REMOVED AS A MEMBER OF A BOARD OR COMMISSION BY A MAJORITY VOTE FOR FAILURE TO ATTEND AT LEAST 50% OF THE REGULARLY SCHEDULED MEETINGS OF THE BOARD DURING 12 MONTH PERIOD PRECEDING THE VOTE, OR FOR VIOLATION OF ANY STATUTE RELATING TO THE RESPONSIBILITIES OF HIS OR HER OFFICE, BASED UPON THE RECOMMENDATION OF A MAJORITY OF THE REMAINING TRUSTEES; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) Notwithstanding any other provision of law to the contrary, any member of a board or commission that was created by state law shall only be removed as a member of such board or commission by a majority vote of the board or commission members, as applicable, for failure to attend at least fifty percent (50%) of the regularly scheduled meetings of the board or commission during the twelve (12) month period preceding the vote, or for violation of any statute relating to the responsibilities of his or her duties as a member of the board or commission, and based upon the recommendation of a majority of the remaining members of the board or commission.
(2) The provisions of this section shall supersede any other provision of law to the contrary.
SECTION 2. This act shall take effect and be in force from and after July 1, 2019.
