AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF D'IBERVILLE, MISSISSIPPI, TO ENTER INTO A MUNICIPAL LEASE PURCHASE FINANCING AGREEMENT WITH QUALIFIED ENTITIES FOR THE PURPOSE OF ESTABLISHING A PUBLIC SAFETY COMPLEX AND RECREATION FACILITIES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The governing authorities of the City of D'Iberville, Mississippi, are authorized, and empowered in their discretion, to utilize a Municipal Lease Purchase Financing Agreement (MLPFA) to acquire and/or construct a new public safety center and recreation facilities.

     (2)  The governing authorities, are further authorized, in their discretion, to select a private-sector, design-build company to construct the public safety complex and one or all of the recreational facilities utilizing the sole-source method or procurement recognized for professional services. 

     (3)  In order to accomplish the objectives under subsections (1) and (2) of this section, the governing authorities of the City of D'Iberville, Mississippi, are authorized, in their discretion, to enter into a long-term lease of up to twenty-five (25) years with an entity or entities selected to participate in the MLPFAs and such entity or entities shall be in adherence to recognized MLPFA standards and practices.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
