AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE TOWN OF BYHALIA TO EXPAND ITS GAS SYSTEM WITHIN A CERTAIN AREA OUTSIDE THE CORPORATE LIMITS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The governing authorities of the Town of Byhalia, in Marshall County, Mississippi, in their discretion, may construct, expand, operate and maintain the gas system of the Town of Byhalia for a distance of beyond five (5) miles from the corporate limits in the following service area:
Commence at the N.W. corner of the N.E. ¼ of an irregular Section being 14, Township 1 South, Range 4 West, Marshall County, Mississippi, said point being the point of beginning, and the line between the State of Mississippi and the State of Tennessee; thence South 3.25 miles to the S.W. corner of the S.E. ¼ of Section 35, Township 1 South, Range 4 West; thence East to the S.E. corner of the S.W. ¼ of the S.E. ¼ of Section 31, Township 1 South, Range 3 West; thence North to the N.W. corner of the N.E. ¼ of the S.E. ¼ of Section 30, Township 1 South, Range 3 West; thence East 1.25 miles to the S.E. Corner of the N.E. ¼ of Section 29, Township 1 South, Range 3 West; thence North 1.75 miles to the N.E. corner of irregular Section 17, Township 1 South, Range 3 West, said point being the North line of the State of Mississippi; thence West along said state line and North line of Section(s) 17 & 18 Township 1 South, Range 3 West and the North line of Section(s) 13 & 14, Township 1 South, Range 4 West to the point of beginning.
(2) The authority conferred by this act shall not be construed as an exemption from the provisions of Section 77-3-1
et seq., as to the requirements for obtaining a certificate of
public convenience and necessity, the jurisdiction of the Public
Service Commission to regulate rates or any other provisions of
that law.
SECTION 2. This act shall take effect and be in force from
and after its passage.
